Second marriage asset protection: What you need to know

Of paramount importance for many people in a second marriage is how to protect their assets if their relationship breaks down, or in the event of their death. Although second marriages bring a level of complexity, there are a number of strategies that you can implement to ensure that your assets are protected.

Let’s explore some of the options available to you and what you need to know to protect your assets.

Binding Financial Agreement

A Binding Financial Agreement, often referred to as a pre-nup, allows you and your spouse to put in place a legal agreement which outlines how your assets will be dealt with in the event that your relationship breaks down. Should you wish, it can also extend to the provision of financial support for either party. The intention is for each party to protect their own assets, and such agreements can be put in place prior to a marriage or during a marriage if both parties consent.

Like any legal document, a Binding Financial Agreement needs to be well drafted to ensure that it encompasses all relevant information, and it is important that you seek the advice of a family lawyer to assist you with putting this important document in place.

Joint Assets v Individual Assets

The manner in which you hold your assets is of paramount importance. All joint assets pass to the surviving party. If you and your spouse own a property as joint proprietors upon your death this property will automatically pass to your spouse. By changing the manner in which you hold the property from joint proprietors to tenants in common allows you and your spouse to deal with your individual interest in the property in your respective Wills.

Additionally, you need to be mindful of any bank accounts or other investments that you hold jointly with your spouse as these are not individual assets that you can make provision for and will pass to your spouse upon your death.

Your Will

It is imperative that you put a Will in place that is reflective of your current circumstances and adequately provides for both your spouse and your children from a previous relationship in the manner that you desire. For many parents in second marriages with children from a previous relationship, protecting their children’s inheritance is of paramount importance.

Discretionary Testamentary Trusts which are created in accordance with the provisions of your Will, can make provision for your spouse during their lifetime, whilst also ensuring that most of your assets go to your children.

If you are the sole registered proprietor of your residence in which you and your spouse reside you may make provision in your Will providing a life interest in your residence to your spouse subject to some conditions being adhered to. This will allow your spouse to reside in your residence for the duration of their life then subsequent to their death the property may then pass to your children.

Dying without a valid Will in place deems that you died intestate, and your assets will be distributed in accordance with a government formula and may not end up with the people who you would like to receive them. Your spouse would be entitled to a share of your assets, however this may not have been your intention, or the share that they would receive may be significantly more than you would like them to receive.

It is therefore crucial that you take the time to put a well drafted Will in place so that your assets pass to those who you would like to receive them upon your death.

Mutual Wills Agreement

A Mutual Wills Agreement is a separate document to your Will and essentially is an agreement between you and your spouse that both of you will not change your Will without the consent of the your spouse or their legal personal representative upon their death.

This document is intended to prevent the remaining spouse from altering their Will and disinheriting step-children or making other adverse changes to their Will.

The Right People in Key Roles

The roles of executor of your Will and your attorney in respect to your Power of Attorney documents are important roles and it is paramount that you appoint trusted people to undertake these roles as essentially you are handing control of your assets to those who assume these roles.

Your attorney is entrusted to look after your finances and provide the best care for you in the event that you become incapacitated so you need to choose wisely.

Communication is Crucial

It is important that there is transparency for you and your family. By having important conversations with your spouse and children you can openly discuss your intentions and expectations so that all parties are relevantly informed and fully understand what your wishes are and what you have put in place.

In order to evaluate the best options for you it is important that you obtain the appropriate professional advice to determine which is the best strategy for your own individual circumstances so that the relevant documents are put in place which offer you the best asset protection possible.

Melisa Sloan is principal of Madison Sloan Lawyers and author of Big Moments: Expert Advice for Conquering those moments that define us. www.melisasloan.com.au

She knows the importance of expressing feelings as well. I wasn’t raised like this at all so our girls are very lucky to be learning from you, baby. Edwina Bartholomew reveals the truth behind her unconventional marriage

Edwina Bartholomew has shared why she doesn't live with her husband full time, and why the unconventional arrangement works for their family.

The Sunrise star first spoke about her unusual situation with husband Neil Varcoe in 2023, when she admitted the married couple no longer slept in the same room.

Now, speaking candidly to Now to Love, Bartholomew has share more insight into their marriage arrangement and how it first began.

“Strangely, it works,” Edwina said.

“We were never ‘date night’ people, but now we’re apart, we go to that extra effort when we’re together to go out for dinner, lunch or to a movie.”

The Sunrise presenter went on to share that the reason Neil first moved out of the city was so he could recover from chronic fatigue syndrome, which he’s been battling for six years.

Neil now lives in the Central West of NSW, three hours from where Edwina lives in Sydney.

“I think he’s the best he’s been for a number of years just by virtue of having that space to recover – eating healthily, exercising, having a really regimented routine,” she said.

“He’s actually really good, which is fantastic, because for a while he definitely wasn’t and it was challenging for both of us. As a wife, it’s hard to see your husband go through that, and hard for him to miss out on things because he can’t physically be there.”

Unsure how long the arrangement will last, Edwina hasn't ruled out moving to the country in the future to be with her husband.

"I think I'd miss the adrenaline of all the back-and-forth, and the excitement,” she admitted. “But sure, one day, it would be lovely to be able to have a family life that’s based in the country – in the distant future.”

Michael Caine shares his secrets to a long life

Michael Caine has shared his top three tips for living a long, happy and healthy life.

While promoting his new movie The Great Escaper, the 90-year-old Hollywood legend credited his nine decades of life to three things.

He told the Daily Mail, "Younger wives, no snacking and wear trainers at all times."

Caine then quickly added, "And you have to be careful not to fall down."

"Happens all the time. You have to just get up and carry on."

Elsewhere in the candid interview, Caine explained how much the business of movie making has changed since his big break, discussing the relatively new phenomenon of having intimacy coordinators on set for love scenes.

Asked about the coordinators, that are not found on most film and TV sets, Caine responded, “Really? Seriously? What are they? We never had that in my day.

“Thank god I’m 90 and don’t play lovers anymore is all I can say. In my day you just did the love scene and got on with it without anyone interfering. It’s all changed.”

Caine shared that his love of movies came after he served in the army, which he believes every able man should do to serve their country.

The actor completed national service in the military himself, serving in Iserlohn, West Germany in the aftermath of World War II and seeing action in Korea.

“I think every young man should be made to do it,” he said. “It truly makes a man of you.”

He added: “I only became an actor after I left the army. I did rep for nine years then got a movie and was like, ‘f*** this! I love films more.’ I liked the money and all.”

Hugh Jackman "devastated" after marriage split

Hugh Jackman has publicly addressed his recent separation for the first time since the news surfaced on Friday September 15. Photographed while running errands in the streets of New York, Jackman's ring finger conspicuously lacked a wedding ring. When approached by a photographer about the breakup, he declined to delve into details, simply stating, "It doesn't feel quite right talking about it on the street."

The 54-year-old actor did, however, acknowledge the challenging situation with a brief remark, saying, "It's a difficult time," before courteously smiling at the photographer and resuming his errands.

His appearance comes in the wake of reports indicating that he was profoundly affected by his split from his wife of 27 years, Deborra-lee Furness. However, some sources suggest that the separation had been a long time coming.

The New York Post's Page Six section cited a source close to Jackman who said that he is “devastated” by the split and that he is “very sad".

An insider from Broadway, where Jackman returned for "The Music Man" in February 2022, revealed that the breakup wasn't a recent development, sharing, "It happened a while ago. Friends and family knew about it."

They added that there was no involvement of a third party and that the couple had gradually evolved into more like "roommates"

The announcement of their separation came as a shock to their worldwide fanbase. The couple shared their decision to part ways through a statement released via People magazine, expressing their gratitude for nearly three decades of marriage and explaining their choice to separate in pursuit of individual growth. The statement concluded by requesting privacy during this transitional phase in their lives.

“We have been blessed to share almost three decades together as husband and wife in a wonderful, loving marriage,” the statement read. “Our journey now is shifting, and we have decided to separate to pursue our individual growth.”

Jackman and Furness then added that “our family has been and always will be our highest priority” as “we undertake this next chapter with gratitude, love and kindness”.

“We greatly appreciate your understanding in respecting our privacy as our family navigates this transition in all of our lives,” the statement continued before they signed off as “Deb and Hugh Jackman”.

“This is the sole statement either of us will make,” the pair concluded.

Jackman and Furness first crossed paths while working together on the Australian miniseries Correlli in 1995. Jackman, who had previously described their connection as love at first sight, knew he wanted to marry Furness just weeks after meeting her. They tied the knot on April 11, 1996.

Their journey together included overcoming miscarriages and embarking on an IVF journey before deciding to adopt. In 2000, they welcomed their son, Oscar, into their family, followed by the adoption of their daughter, Ava, five years later.

Jackman had often openly expressed his deep affection for Furness throughout their marriage. Shortly before the news of their separation emerged, he shared a heartfelt message on Instagram celebrating their 27th wedding anniversary, professing his enduring love and admiration for his wife.

In a recent development, Furness was spotted without her wedding ring just days before the news of their separation became public.

Images: Instagram

How to tell people about your divorce

While it may not be the most pleasant topic of conversation, if you’re in the midst of a separation or divorce you’ll eventually have to tell your nearest and dearest (and some relative strangers) that you are no longer part of a couple. There’s a strong chance that many of us would rather have a tooth pulled than sit down with friends and family and announce that our marriage has ended but putting off the inevitable never ends well. A lack of transparency can make it difficult to move forward while also placing you in the uncomfortable position of having to tell people at an awkward moment down the track when you may have been divorced for months but the news comes as a complete shock to them as they’re hearing it for the first time. Having a strategy for approaching conversations can be helpful, here’s what the experts recommend.

1. Tell your close friends first

There’s a strong possibility they are abreast of the situation already, at least to some extent. Sharing the official news however allows you to start the grieving process and move slowly towards closure. Your closest friends are the ones most likely to be there for you as your life changes and it’s important to let them in and lean on their support.

2. Share with your family

It can be difficult to share with your loved ones that a relationship they may have been part of for years has ended. Telling your children should be of utmost importance. Whether you do that individually or as a group is completely up to you but having an honest conversation and allowing both you and them to grieve is essential.

3. Work

While it’s not always necessary to share the minutia of your life with your workplace, you may need to fill your immediate manager in on what’s happened. Likewise, if you work within a very close knit team or are especially friendly with people at work you may want to let them know.

4. Extended family

Unless you want to subject yourself to a plethora of phone calls, an email may be best for your extended family. Keep them in the loop and let them know what’s happened so that they can offer support but don’t exhaust yourself with feeling as if you need to explain the situation to every single person in your life.

Images: Getty

Then and now – how the concept of arranged marriage has changed throughout the years

At the age of 24, Meera Patel had set her sights on finding a husband within a year, and she did exactly that with the help of her parents and the age-old tradition of arranged marriage.

Having never dabbled in the world of dating, let alone marriage, the Sydney pharmacy student made sure to keep her expectations realistic. Speaking to the ABC, she said that she wasn’t planning on “casting positive thoughts into the universe".

As a Gujarati Indian woman, the concept of arranged marriage is common but over the years, it has modernised to become adaptable with today’s society. The method, which is a popular form of matchmaking in South Asia, dates to thousands of years.

A study on the youth of India conducted in 2016 found that 84 per cent of married couples had an arranged marriage.

The tradition – which has a stigma attached to it – has evolved over the past 50 years, according to Nonie Tuxen, a PhD student and resident of Mumbai.

“If you speak to a lot of people here in India over the age of, say, 75, many of them did not see or speak to their spouse prior to their wedding,” she said.

“Whereas nowadays, young people both here in India, and in the diaspora, have a great deal of say in who they marry.

“There’s a lot of confusion about whether an arranged marriage is forced in some way – it never is, forced marriage is an entirely separate issue.

“The decision ultimately lies with them … it doesn’t lie with their families.”

Which is why, when Meera believed the time was right, she asked her parents to help her find a husband.

Meera’s close friend, Hemangini Patel, says that the lines between “love marriages” and arranged marriages are blurring.

“I just thought that your parents introduced you to someone and you had to get married in, like, a month,” she says.

But according to Hemangini, Meera felt overwhelmed by the world of dating once she had reached her 20s, which is when marriage becomes a commonly spoken about topic amongst the Indian community.

“I was doing a Master’s degree which was a two-year course … so [I had] no time to think about anything except for work and studying” says Meera.

“I would have no idea where to go and look for a person.

“So, when my parents approached me with the idea [of arranged marriage] … I’m like, ‘Yes! You do all the work for me and I’m happy with whatever!'”

But Meera was never dreaming about Prince Charming, and her list of expectations in her potential partner had nothing to do with outward appearance, but rather she was focused more on his culture and beliefs.

Meera’s Prince had to be Hindu and belong to the BAPS Swaminarayan faith.

“I’m very religious, so I wanted someone with the same religious background as me, to make it easier for us to understand each other,” she said.

“We have some dietary requirements – we don’t eat onion and garlic, and we’re very strict vegetarians, as well, so I wanted someone who can understand that.”

Language was also an important factor that had to be considered. The BAPS Swaminarayan faith, which was established in the east-Indian state of Gujrat, has a majority of Gujarati speakers.

“I wanted someone who could not only communicate with my parents but everyone else in my family,” says Meera.

After Meera approached her parents about the possibility of an arranged marriage, they got in touch with Gujarati families across the world.

While they went through many potential suitors, it was ultimately a New Zealand man, Rushi, who stole Meera’s heart.

“My dad contacted his dad, and after that we exchanged numbers,” she said.

After getting to know each other through text and phone calls, Meera and Rushi flew to one another to meet each other’s families.

That was two years ago. Now, as Meera and Rushi get ready to marry each other in January, they know each other better than they know themselves.

“It’s going to be a big wedding from what I hear because it’s going to be planned by parents fully,” she says.

“As long as they’re happy, I’m happy.”

“What a legend”: Groom exposes new wife’s affair during wedding speech

A groom has exposed his new wife after finding out she had been having an affair with his best man during a speech at their wedding.

The scorned groom handed out intimate photos and explicit videos of his wife and the best man together before announcing he would be “leaving now”, dropping the microphone and then walking off with his family, who had been pre-warned.

On The Unfiltered Bride podcast, wedding planners Georgina and Beth spoke about the shocking story.

Georgina said although his family knew, he wanted to go ahead with the wedding so that the bride would have to pay for all the food.

They posted a snippet of their podcast on TikTok, which quickly went viral.

Georgina said on the podcast, “I've got another story to tell you. I can't tell you who told me because I'm not really allowed to tell the story, but f**k it I'm going to tell the story anyway. So there was a wedding and they did the wedding, bride and groom got married, lovely ceremony, drinks reception, sat down for wedding breakfast, had their food, speeches after food.”

“Father of the bride does his thing, groom stands up and says, ‘Just before I properly get started, there's some envelopes coming round now. If you could all open them up. Yeah those are pictures of the bride f*****g the best man so I'll be leaving now.’ Dropped the microphone and him and all his family knew about it and left because they wanted the bride to have to pay for the food.”

Beth then asked, ”So the bride paid for everything?” To which Georgina replied, “The bride's family paid for everything.”

The video sparked numerous reactions.

“My mouth actually dropped. OMG!!!” one person said.

“I don’t blame him at all!! I’d do the same 😂😂” another added.

“But WHY did he still marry her?” a third asked.

“I admire the patience of the groom and family to get through the whole thing without slipping up once. 😅” another added.

“I can imagine the divorce papers”: Ben Fordham's marriage deal-breaker

Ben Fordham has revealed his marriage deal-breaker during a chat about tracking devices for 9Honey’s “He Se She Said” with Shelly Horton.

The radio giant, who hosts Ben Fordham Live on 2GB, shared that while he and his wife Jodie Speers track their children’s whereabouts via tracking apps on their smartwatches, they would never do that to each other.

"If I said to Jodie, 'Hey, I'm going to start tracking your whereabouts,' I can imagine the look that I'd get, first of all, from Jodie, then I can imagine the conversation that I'd be having with Jodie, and then I can imagine the divorce papers that would be filed by Jodie," Fordham joked.

"I can imagine Jodie just getting a hammer and smashing her watch," Horton remarked.

Horton discussed how the desire to track speaks of a "lack of trust," and at the worst of times, it could suggest “coercive control” seen in domestic violence relationships.

Fordham agreed, adding he and his wife of over a decade have no desire to track each other.

"We've got it for the kids. But I don't know where Jodie, is and she doesn't know where I am, apart from our diaries, because we've got a diary where we kind of let each other know where we're going to be and what we're doing," he said.

In terms of the idea of “coercive control” Fordham said, "And you might have people who feel like, 'Alright, if I've got nothing to hide, OK, I'll agree to this arrangement,” adding that this arrangement can be exploited.

Horton then spoke about refuges and “safe” spaces that have been implemented in shopping centres to help people, primarily women, who are being tracked so closely by their partners that they are unable to seek assistance.

"They can go to a shopping centre and get counselling there, and actually talk to people about how to exit the relationship, and the partner just sees them at the shopping centre," she said.

Fordham highlighted that once couples have agreed to track each other’s whereabouts, stopping it “becomes a problem” so it is best to avoid it from the start.

"Because the moment you say to the other person , 'Hey, look, I don't like this thing anymore, I don't want to be tracked anymore, then they'll be thinking, 'Oooh, what have you got to hide?”

Fordham also suggested setting up boundaries at the beginning of a relationship.
