Air traffic controller found asleep on the job

<p>An air traffic controller has been found asleep on the job, with the incident prompting calls for better fatigue management, according to Australia's transport watchdog. </p> <p>The report by the Australian Transport Safety Bureau (ATSB) dates back to December 2022, when the Airservices Australia controller was found lying across two chairs with a blanket covering them at 5am.</p> <p>The controller had worked multiple night shifts with reduced extended rest periods, "which likely reduced their ability to obtain restorative sleep", the report claimed. </p> <p>ATSB chief commissioner Angus Mitchell said the controller had increased their chances of falling asleep "by lying across two chairs, not moving, and not undertaking activities to maintain mental alertness".</p> <p>When a colleague discovered the snoozing worker, there was no traffic in the Cairns airspace they were responsible for managing, which was usual for that time of day, and there were no scheduled flights until after their shift.</p> <p>However, the report highlighted the possible problems the incident pay have caused, saying if the traffic controller was woken up by a radio broadcast, they may have experienced "sleep inertia", with the risk of delayed communications, or incorrect instructions or actions.</p> <p>"There were no negative consequences from this occurrence, but it does highlight areas for improvement in work scheduling and fatigue risk management," said Mitchell .</p> <p>Since the incident, Airservices Australia has increased its overall number of air traffic controllers, and has also drawn up new guidelines and training about fatigue risk assessment.</p> <p>"Fatigue remains one of the most relevant ongoing concerns for safe transport, despite increased awareness across the transport sector," said Mitchell.</p> <p><em>Image credits: Shutterstock </em></p>

Six old-school strategies to cope with disruptive airport tech

<div class="theconversation-article-body"><em><a href="https://theconversation.com/profiles/christopher-schaberg-1451119">Christopher Schaberg</a>, <a href="https://theconversation.com/institutions/arts-and-sciences-at-washington-university-in-st-louis-5659">Arts &amp; Sciences at Washington University in St. Louis</a></em></p> <p>Ten years ago I wrote a book titled “<a href="https://www.bloomsbury.com/us/end-of-airports-9781501305498/">The End of Airports</a>” about how digital technologies and commercial air travel were on a collision course. Earlier this summer, I was proved right.</p> <p>In July, <a href="https://theconversation.com/massive-it-outage-spotlights-major-vulnerabilities-in-the-global-information-ecosystem-235155">a cybersecurity software outage</a> snarled airports around the world. Airlines took weeks to get back to normal. Delta was particularly <a href="https://www.cnn.com/2024/08/07/business/delta-passengers-sue-crowdstrike-meltdown/index.html">hard hit</a>, with some <a href="https://apnews.com/article/crowdstrike-technology-outage-fallout-delta-c287aaded657a1092724b222435c3d16">7,000 flights canceled</a> and delays lasting well into August.</p> <p>As an expert on air travel who contemplates flight from <a href="https://www.bloomsbury.com/us/textual-life-of-airports-9781441189684/">a humanistic and cultural studies perspective</a>, I think the new technologies woven into air-travel management are a double-edged sword. While they enhance elements of safety and efficiency, they can also make the entire system <a href="https://www.theatlantic.com/ideas/archive/2024/07/crowdstrike-failure-warning-solutions/679174/">more fragile and vulnerable</a>.</p> <h2>The downsides of digital technology</h2> <p>To be fair, aviation depends on technology. Humans would never have gotten off the ground without it. But new technology can create new problems even as it solves old ones. The latest digital tech offers necessarily imperfect ways to manage a vast, intricate network of places, machines and people.</p> <p>And as the computer systems get more fine-tuned and integrated, they also can result in catastrophic failures, precisely because of the connective nature of tech. And let’s not even talk about <a href="https://theconversation.com/how-hot-weather-and-climate-change-affect-airline-flights-80795">the weather</a>.</p> <p>The past summer’s <a href="https://www.cbsnews.com/news/crowdstrike-outage-bug-bad-data-falcon-update-microsoft/">software glitch event</a> won’t be the last time some unforeseen variable brings air travel to a halt. Fortunately, travelers don’t have to depend solely on airport technology systems or our own smart devices for seamless travel. Here are six analog strategies that travelers can use to cope with air travel debacles:</p> <h2>Old-school flying suggestions</h2> <ol> <li> <p><strong>Pack smart for potential delays.</strong> Make sure you have a carry-on that includes whatever you’d need for an unplanned overnight stay at a hotel – or worse, on an airport floor. Take <a href="https://www.tsa.gov/travel/security-screening/liquids-rule">Transportation Security Administration-approved toiletries</a> and enough clothes so you can deal with a layover somewhere you didn’t expect. And wear comfortable shoes.</p> </li> <li> <p><strong>Be kind to airline employees and airport staff, who can’t control delays or cancellations.</strong> Remember that no one airline employee can automatically fix the problem when a software malfunction happens or a freak storm grounds planes. But if you are kind and patient, an airline employee may just comp you a hotel room or give you a more generous rebooking arrangement. Also: It’s just the humane thing to do.</p> </li> <li> <p><strong>Purchase your tickets directly from airlines.</strong> It’s not worth saving $20 or $50 on a ticket deal from a third-party vendor. When delays and cancellations happen, if you have such a ticket, the airline will have less interest in aiding you. Buying tickets directly from the airline will help you get back in the air quicker.</p> </li> <li> <p><strong>Have a plan B.</strong> In the event that your connecting flight is canceled mid-trip, have you contacted someone you know in that city? Or have you researched hotels easily accessible from the airport? What would it take to get a comfortable spot for a night? A little homework can go a long way if you end up stranded.</p> </li> <li> <p><strong>Bring healthy snacks and other supplies.</strong> It’s smart to pack vitamins, zinc, hydration packets, a reusable water bottle, medications, hand sanitizer, or whatever helps bolster your health during a travel stint. If you get waylaid for a few hours or overnight, preplanning some self-care items can help you avoid contagious illnesses and general fatigue.</p> </li> <li> <p><strong>Enjoy the airport.</strong> It’s a fascinating place where so many people converge. If you’re <a href="https://stuckattheairport.com">stuck at the airport</a> for several hours, use that time to find interesting things in the concourses. You might discover art shows, a great bookstore, a yoga room or a movie theater. It can be tempting to just stand around the gate area and seethe. But it’s more fun to move around the airport and explore what’s there.<!-- Below is The Conversation's page counter tag. "No show": Wild reason couple denied refund on flights scheduled during Covid

<p>A Melbourne couple, who had booked flights with Qantas during the state's fifth lockdown, were left furious after they were told they were ineligible for a refund because they were a "no show". </p> <p>Kieran McGregor told <em>news.com.au</em> that he and his partner had originally booked the flights to Darwin for July 18, 2021 through travel giant Expedia. </p> <p>When the number of Covid cases started rising, he moved the flights forward to fly out on the 16th of July, hoping that they would be able to get out before another lockdown, but the day before their flight, Victorian Premier Daniel Andrews announced the state's fifth lockdown. </p> <p>Three years later, McGregor was still stuck between trying to get the refund from Expedia, who said Qantas had the money, and Qantas, who said the travel agent had it.</p> <p>Last year, McGregor contacted Expedia on their X account to try to resolve the issue, but the company said:  “We just got off the phone with the airline, and as per advised, the ticket shows suspended on their end due to a no show."</p> <p>“Your ticket is no (sic) eligible for a refund, and has no value as per the airline. We apologize for the inconvenience.”</p> <p>He was "incredulous" when he received the message. </p> <p>“How could I fly if the state of Victoria was in lockdown and I couldn’t move more than 5km from the house?” he told news.com.au. </p> <p>When he contacted Qantas, the airline claimed “the funds will still remain with the agency that you’ve booked with” and to contact them directly for a refund.</p> <p>McGregor told news.com.au the ordeal was “utterly disgraceful” and that he was unaware if the flight went ahead or not. </p> <p>The publication reportedly contacted Expedia and Qantas and on Tuesday morning they finally said that a refund would be issued, but McGregor said he was yet to be contacted.</p> <p>“For flight bookings at Expedia, we generally follow the policies of our travel partners, so any refund is determined by the airline,” an Expedia spokeswoman said.</p> <p>“We have looked into this case with Qantas, and we will be contacting the traveller to process the­ refund.”</p> <p>While a Qantas spokesman said: “We apologise for the extended delay in resolving this issue and are processing a full refund for their bookings.”</p> <p>It is unclear which company held McGregor's funds, which was reported to be around $2,500. </p> <p>Adam Glezer from Consumer Champion told news.com.au that McGregor came to him recently when he felt he had nowhere else to turn.</p> <p>He said that these situations were quite common. </p> <p>“What Kieran has gone through with Expedia and Qantas is extremely common where the third party says the airline has the money and the airline says the third party has the money. Paris makes controversial Olympics decision

<p>The mayor of Paris has caused an uproar amongst locals are announcing plans to keep the Olympic rings on the Eiffel Tower indefinitely. </p> <p>In an interview with Ouest-France, Mayor Anne Hidalgo said the iconic landmark will be keeping the Olympic symbol after the conclusion of the summer Games. </p> <p>“The decision is up to me, and I have the agreement of the IOC [International Olympic Committee]. So yes, they [the rings] will stay on the Eiffel Tower,” she said. </p> <p>The giant Olympic rings, measuring 29 meters wide and 15 meters high, were installed on the Eiffel Tower ahead of the Paris Olympics, which began on July 26th, and were set to be dismantled after the Paralympic Games draw to a close on September 8th. </p> <p>However, Hidalgo is pushing to keep them in place permanently, albeit in a lighter version, replacing the current 30-tonne structure.</p> <p>The plan has drawn mixed reactions from Parisians, with many slamming the idea and calling out the "defiling" of the iconic French landmark. </p> <p>“It’s a historic monument, why defile it with rings? It was good for the Olympics, but now it’s over, we can move on. Maybe we should remove them and return the Eiffel Tower to how it was before,” one local told French publication <em>France Bleu</em>.</p> <p>Descendant of the Eiffel Tower designer Gustave Eiffel even chimed in on the debate, as a family statement read, "It does not seem appropriate to us that the Eiffel Tower, which has become the symbol of Paris and the whole of France since its construction 135 years ago, has the symbol of an outside organisation added to it in a permanent way, whatever its prestige."</p> <p>The SOS Paris group, which campaigns to protect Paris's landmarks and environment, added, "The Eiffel Tower has a history of 135 years and surpasses a sports and media event of 17 days," while the chairman of the association Friends of the Champs de Mars, the park around the Eiffel Tower, said the idea "needed to be the subject of a wider consultation".</p> <p>However, some people were in favour of the rings remaining on the Eiffel Tower, as one local told the publication, “The Eiffel Tower is very beautiful, the rings add colour. Residents slam "entitled" picnic table act at popular beach

<p>With the weather warming up in Sydney, locals have started to take advantage of the sun and head to beach, but with sunny days come debates about picnic (or any) table etiquette. </p> <p>One beachgoer has copped some backlash after they taped up a sign to a public picnic table in Balmoral Beach on Saturday, which read: "Reserved 31/8 from 1pm" - and with no one in sight. </p> <p>A frustrated local shared an image of the table on Facebook, writing: "Really? Love to know where you place the official booking. Both tables 'reserved'."</p> <p>In the comments some labelled the move "unacceptable" while others were quick to point out that reserving tables is "not allowed". </p> <p>"Yeah, nah. Can’t reserve public tables. You want it, put the effort in and sit there the whole day from 8am," one wrote. </p> <p>"If you won't remove the reserved sign please update this post to add a picture of the group when they claim their tables. If they're that bold and brazen to make the reserved sign they will appreciate the free publicity," another added. </p> <p>A third wrote that they would be "ok if they said for a wedding or a super important event I would let them go for it" but others disagreed.</p> <p> A Mosman Council spokesperson told <em>Yahoo,</em> "council does not take bookings for picnic tables or promote reserving them."</p> <p>This is not the first time someone has tried to reserve a public picnic table, with one person etching a "reserved" note in chalk on the pavement at a park in Brisbane. </p> <p>Locals shared a similar response, calling the move "entitled." </p> <p>"Pretty sure that message on the concrete would motivate others to sit there when they otherwise wouldn't. <p>When it comes to travelling by plane, some trips are better than others. </p> <p>While some people have a general fear of flying, others are traumatised from flights from hell that turn bumpy for a list of different reasons. </p> <p>We asked our readers to tell us about their worst flying experience, and the response was overwhelming. Here's what they said. </p> <p><strong>Lee Ayles</strong> - On a flight Melbourne to LA. No kidding, 8hrs of rocking and rolling the whole time. The lady sitting behind me had her rosary beads and praying non- stop, my daughter slept through the whole ordeal. The flight attendants were so helpful and put us at ease. Think I drank gin and tonics through the whole thing. Needless to say slept the next 4 hours before a great landing in LA.</p> <p><strong>Roz Weitenberg</strong> - Flying from Columbo (Sri Lanka) to the Maldives in a twin engine King Air 350. My husband was flying the airplane and we got caught up in a storm that was so intense, I really thought the poor little aircraft would break up. Even the Sri Lankan B777 ahead of us was going to turn back to Columbo. That was the worst flying experience I have ever had.</p> <p><strong>Anne Morrison</strong> - Last year flying Singapore to Johannesburg, South Africa and return (which was worse). So much turbulence the whole way I was actually sick, lady in front said "we're all going to die" and I thought so too. Tray broken, no screen and food and service nearly non existent. Disgusting, and the same on the way back. The lightning was very intense, seemed to be so close that it appeared all the planes interior lights were on.</p> <p><strong>Audrey Forrester</strong> - Flying out of Kununurra and the pilot forgot to put cap on fuel. We ran out and had to emergency land on Lake Argilewe, thankfully we were in a sea plane. </p> <p><strong>Lorraine Taylor </strong>- Singapore to Zurich with Swiss Air. The woman in front of me lowered her seat far back I was pinned in my seat. I asked the air hostess for help and she said there was nothing she could do. I couldn’t move for 8 hours and despite continually asking her to raise her seat she just laughed. Strangers lock toddler in plane bathroom to stop her tantrums

<p>The video of a controversial incident on a plane has caused outrage, as two women reprimanded a screaming toddler by locking her in the bathroom on the aircraft. </p> <p>On a Juneyao Airlines flight from Guiyang to Shanghai, China, in late August, a one-year-old child, who was travelling with her grandparents, reportedly sobbed non-stop during the nearly three-hour flight according to the <a href="https://nypost.com/2024/08/30/lifestyle/strangers-lock-crying-tot-in-airplane-bathroom-to-educate-her/" target="_blank" rel="noopener"><em>NY Post</em></a>. </p> <p>After being fed up with the toddler's tantrum, two women who were strangers to the family reportedly transported her to the bathroom to “educate her.”</p> <p>Shockingly, the child’s grandmother consented to the treatment.</p> <p>The punitive pair then shared the video of this alleged “potty training” on Douyin, China’s version of TikTok.</p> <p>In the clip, the women can be seen seated in the locked lavatory with the screaming infant, as one of the women is heard saying, “If you stop crying, aunty will take you back to grandma” and “We won’t let you out unless you stop crying.”</p> <p>As the girl stopped crying, the woman filming the video picked her up and told her: “If you make any noise again, we’ll come back (to the bathroom).”</p> <p>One of the women was initially proud of her cruel and unusual-seeming form of discipline, as she wrote that the tantrum was so disruptive that “many passengers were using tissues to block their ears” while others “had moved to the back of the plane to escape the noise.”</p> <p>According to a statement from the airline, the little girl's mother, who was not travelling with them, reportedly sympathised with the self-appointed aeroplane posse’s behaviour.</p> <p>Since the video went viral, and was subsequently deleted, Juneyao Airlines’ reps have since condemned the pairs’ actions and apologised for the incident and “oversight of the crew”.</p> <p>Despite the video being wiped from the social media site, many were quick to slam the behaviour of the women, saying their discipline was completely unacceptable. </p> <p>“Adults in their 30s can have emotional breakdowns, but people don’t allow toddlers to have theirs,” one person commented, </p> <p>Another wrote, “The grandmother and the two aunts should be sued, and social services should intervene. If there are parents like this, children will suffer in the future.”</p> <p>“When will these people understand that babies have the right to cry and the right to travel, they are part of society, and so are babies!!!!!!!” declared a third.</p> <p><em>Image credits: Weibo</em></p>

‘It’s time to give up on normal’: what winter’s weird weather means for the warm months ahead

It followed a <a href="https://www.9news.com.au/national/australia-weather-update-nsw-and-victoria-damaging-winds-high-fire-danger-warnings/0f9b19d8-dc81-44c9-8df4-679cbb67c055">high fire danger</a> in Sydney and other parts of New South Wales last week, and <a href="https://www.abc.net.au/news/2024-08-28/fire-grass-emergency-warning-firefighter-horningsea-park/104281180">a fire in south-west Sydney</a> that threatened homes.</p> <p>The severe weather rounds out a weird winter across Australia. The nation’s <a href="https://www.theguardian.com/australia-news/article/2024/aug/26/winter-heat-records-broken-as-australia-set-for-more-temperatures-over-10c-above-average">hottest ever winter temperature was recorded</a> when Yampi Sound in Western Australia reached 41.6C on Tuesday. Elsewhere across Australia, winter temperatures have been <a href="https://www.theguardian.com/australia-news/article/2024/aug/28/nsw-weather-forecast-fire-danger-warnings-sydney-bom">way above average</a>.</p> <p>We can look to the positives: spring <a href="https://www.theguardian.com/australia-news/article/2024/aug/26/australias-early-spring-brings-budding-flowers-chirping-birds-and-climate-alarm">flowers are blooming early</a>, and people have donned t-shirts and <a href="https://www.smh.com.au/environment/climate-change/spring-comes-early-after-warm-winter-with-more-heat-on-the-way-20240828-p5k63i.html">hit the beach</a>. But there’s a frightening undercurrent to this weather.</p> <p>Earth’s climate has become dangerously <a href="https://science.nasa.gov/climate-change/extreme-weather/">unstable</a>, and it’s only a matter of time before we get the bad combination of hot and dry weather, strong winds and a spark. None of this should come as a surprise. The sooner we stop expecting Australia’s weather to be “normal”, the sooner we can prepare for life in a wild climate.</p> <figure><iframe src="https://www.youtube.com/embed/003XSg5AZBk?wmode=transparent&amp;start=0" width="440" height="260" frameborder="0" allowfullscreen="allowfullscreen"></iframe></figure> <h2>The green is deceiving</h2> <p>The landscape around Sydney – and in fact, across much of south-east Australia – is very green at the moment. That’s because we’ve had a couple of years of good rains which triggered an explosion of vegetation growth.</p> <p>The below NASA satellite image reveals the picture in stark detail. It’s certainly lush out there at the moment.</p> <p>But the problem with climate change is that weather conditions can turn on a dime. This August was a case in point. At month’s end, much of Australia was hit by a record-breaking heatwave and <a href="http://www.bom.gov.au/australia/charts/synoptic_col.shtml">damaging winds</a> – conditions that can dry out a green landscape with devastating efficiency, turning it into fuel for a bushfire.</p> <p>The dangerous fire weather that struck Sydney this week came as a surprise to many. But in reality, these abnormal conditions are the new normal.</p> <p>We must open our minds to this, if we want to be prepared.</p> <h2>A climate off the rails</h2> <p>The year 2023 was Earth’s <a href="https://www.climate.gov/news-features/featured-images/2023-was-warmest-year-modern-temperature-record#:%7E:text=The%20year%202023%20was%20the,decade%20(2014%E2%80%932023).">hottest on record</a>. And <a href="https://www.carbonbrief.org/state-of-the-climate-2024-now-very-likely-to-be-warmest-year-on-record/">2024 looks likely</a> to be hotter still.</p> <p>In Australia, the last 12 months have provided all the evidence we need that our climate is wobbling on its rails.</p> <p>In October 2023, Victoria’s Gippsland region suffered unseasonably early bushfires, then soon after battled <a href="https://www.abc.net.au/news/2023-12-05/gippsland-fires-and-multiple-floods-breeding-resilience/103179368">heavy rain and flooding</a>.</p> <p>And Tasmania, where I live, <a href="https://www.abc.net.au/news/2024-03-07/tas-drought-conditions-as-dry-tasmania-looking-very-brown/103546058">has been gripped by drought</a>. This February was Hobart’s third driest in 143 years. But over the weekend we were hammered by a <a href="https://www.abc.net.au/news/2024-09-01/tas-flood-warnings-severe-weather-sunday/104296092">deluge of rain and wind</a>.</p> <p>This climate instability is setting up bad fire conditions. Not everywhere in south-east Australia will be hit by fire, but it will happen somewhere. It could be the hinterlands or the coast. It will depend on how our erratic climate behaves in the coming months.</p> <p>Let’s stick with the Tasmania example. Sure, the surface soils are now nicely saturated. But that will lead to a burst of grass and other vegetation in spring. If the dry weather returns and the temperatures heat up in summer, the fine fuels will dry out and become dangerously combustible.</p> <p>All we need then is a windy day and a spark, and a nightmare fire will soon be racing across the landscape.</p> <h2>Canada on fire</h2> <p>Of course, Australia is not the only country facing climate instability and a worsening fire risk.</p> <p>Canada suffered a catastrophic wildfire season in 2023 – one of the most severe on record. It burnt almost 15 million hectares and forced the evacuation of 232,000 people.</p> <p>Smoke produced by the fires affected communities up to 1,000 km away, such as in southern Canada and on the east coast of the United States.</p> <p>A <a href="https://www.nature.com/articles/d41586-024-02653-6">recent paper</a> in the journal Nature Communications outlined why. It pinpointed early snowmelt, early-season drought conditions and intense heat. In fact, the average temperature in Canada from May to October last year was 2.2°C higher than the 30-year average.</p> <p>The researchers said human-caused climate change exacerbated the fire’s effects. It went on:</p> <blockquote> <p>The disproportionate effect a few days of extreme weather can have on the total area burned is also evident in this fire season, leading to worrisome prospects given projected future conditions.</p> </blockquote> <h2>Normal no longer exists</h2> <p>It’s always been difficult to forecast fire seasons in Australia, due to our natural climate variability.</p> <p>But now we are seeing climate instability <a href="https://www.csiro.au/en/research/environmental-impacts/climate-change/state-of-the-climate/previous/state-of-the-climate-2018/australias-changing-climate">layering over itself</a>: background dryness, wet seasons bringing a proliferation of fuels, and above-average temperatures.</p> <p>Eventually we’ll get unlucky and experience extremely strong winds thrown into the mix. That’s when catastrophic fires are most likely to occur.</p> <p>As we saw in the <a href="https://theconversation.com/australias-black-summer-of-fire-was-not-normal-and-we-can-prove-it-172506">Black Summer of 2019–20</a>, and again in Canada last year, some fires are so intense they completely overwhelm fire suppression strategies.</p> <p>Under climate change, the likelihood of getting a bad combination of weather conditions is increasing. So what’s the remedy?</p> <p>Australia really must start making our communities more resilient. Serious and sustained adaptation is needed. As my <a href="https://www.science.org/doi/full/10.1126/science.adi8066">research has outlined</a>, this requires the careful integration of:</p> <ul> <li>community education programs</li> <li>research and development to design fire-safe homes, gardens, communities and bushland</li> <li>incentives and penalties to ensure adaptation measures are implemented.</li> </ul> <p>As this winter has shown, Australia’s climate is entering a different phase. Tourists reveal the world’s best “non-mainstream” cities

<p dir="ltr">While many eager travellers head to a nation’s capital city when travelling abroad, others prefer to steer off the beaten track for a more authentic experience. </p> <p dir="ltr">A group of keen tourists discussed their favourite “non-mainstream” cities in a popular travel thread on Reddit, with eight destinations around the world coming out on top. </p> <p dir="ltr"><strong>Turin, Italy</strong></p> <p dir="ltr">Most travellers that head to Italy tend to stick to the main tourist-driven cities of Rome, Florence, Milan and Venice. </p> <p dir="ltr">However, according to one traveller, the city of Turin (also known as Torino) is “one of the best cities in the country and it gets ignored by most tourists.”</p> <p dir="ltr">One person wrote, “Great architecture, very walkable, fantastic museums, delicious regional dishes and stunning Alpine backdrop.”</p> <p dir="ltr">Another agreed, adding, “Torino is really great. [It] feels different to any other Italian city. [It's] also totally uncrowded even during peak season.”</p> <p dir="ltr"><strong>Oulu, Finland</strong></p> <p dir="ltr">Aside from the Finnish capital of Helsinki in the far south of the country, some travellers prefer to venture up north into colder climates away from the bustling city. </p> <p dir="ltr">One hotspot is the city of Oulu, which offers a more relaxed pace of life despite its harsh weather. </p> <p dir="ltr">One traveller wrote, “I really enjoyed Oulu in Finland. So much space between buildings, green trees everywhere, a nice beach to relax on and watch the sunset, [and] beautiful parks.”</p> <p dir="ltr">“To me, it looked like the ideal city to live in. I was there in July. I think winters can be harsh.”</p> <p dir="ltr"><strong>Ouray, Colorado, USA</strong></p> <p dir="ltr">Situated in the heart of the San Juan Mountains in southwest Colorado, Ouray is often referred to as the 'Switzerland of America', with many travellers in awe of its beauty. </p> <p dir="ltr">One person simply wrote, “Ouray is stunningly beautiful!” sharing their love for the quaint city. </p> <p dir="ltr"><strong>Nuremberg, Germany</strong> </p> <p dir="ltr">Germany’s most visited cities are usually Berlin and Munich, but Nuremberg also offers a unique glimpse into Germany’s history and culture. </p> <p dir="ltr">One traveller described the city as “amazing” while another said they “absolutely loved the place”. </p> <p dir="ltr">Another claimed that Nuremberg was “so beautiful, magical and fun” during wintertime that it “ruined Christmas for the rest of my life”.</p> <p dir="ltr"><strong>Townsville, Australia</strong></p> <p dir="ltr">When you think of coastal Aussie getaways, many think of Noosa or the Gold Coast as the best places to visit. </p> <p dir="ltr">However, others encouraged travellers to head to the “super-underrated” Townsville in northeastern Queensland instead.</p> <p dir="ltr">One traveller remarked that it has “great bars and restaurants”, adding, “It was a good base to get around the place. I found the locals friendly, [it] wasn't overrun with tourists like Cairns. My wife and I both thought it was a super-underrated place and we'll be back.”</p> <p dir="ltr"><strong>Khiva, Uzbekistan </strong></p> <p dir="ltr">The city of Khiva, locally pronounced 'Heevah', is more than 2,500 years old and is a keen holiday destination for history buffs. </p> <p dir="ltr">One traveller wrote of the charming city, “The old city inside the walls is so well preserved that it's like entering another time. Early morning and after dark, when the tourist market has closed, and the buses have left, makes for a magical experience. I've been to a lot of places in the world but will never forget the magic of that place.”</p> <p dir="ltr"><strong>Salta, Argentina</strong></p> <p dir="ltr">Located in the north of the country, Salta is “definitely not on the mainstream path”, but worth the journey.</p> <p dir="ltr">One tourist wrote, “The city itself isn't the most exciting but it's safe, the food is incredible, and it's the gateway to some of the most beautiful natural areas I've seen in my life.”</p> <p dir="ltr"><strong>Kastoria, Greece</strong></p> <p dir="ltr">Located in northern Greece in the region of Western Macedonia, Kastoria sits on the shore of Lake Orestiada and is surrounded by limestone mountains. </p> <p dir="ltr">One traveller fell in love with the Greek destination, writing, “This is the definition of a hidden gem. It's deep in northern Greece and on a peninsula jutting into the middle of a lake, so it's just this incredibly serene and picturesque setting. Aussie travellers warned over bird flu outbreak

<p>Australian travellers have been warned to be cautious after concerns about the sudden outbreak of bird flu. </p> <p>Strains of Avian Influenza, known as the bird flu, are circulating across the globe, with <a href="https://www.smartraveller.gov.au" target="_blank" rel="noopener">Smart Traveller</a> warning of outbreaks in Europe, North and South America and Asia.</p> <p>“Human infection is rare. But be aware of increased health risks when travelling to impacted countries,” the alert states.</p> <p>The virus typically affects birds but can be transferred to other animals before being passed on to humans. </p> <p>“Eggs and poultry meat are safe to eat if handled and cooked using safe food handling practices,” the alert states.</p> <p>Travellers have been urged to look out for signs of infection, including eye redness or irritation (conjunctivitis), fever, cough, sore throat, runny or blocked nose, muscle or body aches, fatigue, shortness of breath or difficult breathing, and pneumonia.</p> <p>Travellers have also been urged to minimise contact with animals in areas affected by the bird flu, avoid contact with dead or sick animals (including wild birds), and avoid poultry farms and live bird “wet” markets.</p> <p>While there is no specialised vaccine for bird flu, travellers have been urged to check that their other influenza vaccines are up to date before travelling. </p> <p>Smart Traveller states, “If you feel unwell while travelling back to Australia, tell a crew member or airport staff. Why aren’t the Olympics and Paralympics combined into one Games? The reasoning goes beyond logistics

<div class="theconversation-article-body"><em><a href="https://theconversation.com/profiles/laura-misener-992664">Laura Misener</a>, <a href="https://theconversation.com/institutions/western-university-882">Western University</a> </em></p> <p>As the lights go out on an outstanding Olympic Games in Paris, with <a href="https://www.cbc.ca/mediacentre/press-release/7-in-10-canadians-tune-in-for-paris-2024">record-breaking media attention</a> and <a href="https://olympic.ca/press/paris-2024-team-canada-brings-home-historic-medal-haul/">excellent medal results for Team Canada</a>, it’s important to remember the Games aren’t over — it’s just the halfway mark.</p> <p>While the closing ceremonies on Aug. 11 seemed like the end of the event with the <a href="https://www.ctvnews.ca/sports/as-the-olympic-flame-heads-for-los-angeles-what-can-we-expect-from-the-2028-games-1.6997247">official handover to Los Angeles for the 2028 Summer Games</a>, the 2024 Games are really just on pause.</p> <p>This two-week break between Olympic and Paralympic Games isn’t a respite at all. Paris is now getting ready to host the Paralympic Games, which will <a href="https://olympics.com/en/paris-2024/information/competition-schedule-for-the-paralympic-games">begin on Aug. 28 with the opening ceremony</a>.</p> <p>In two weeks, a whole new set of elite international athletes will descend on Paris for the <a href="https://olympics.com/en/sports/paralympic/">third largest sporting event</a> in the world. Canada will be sending <a href="https://paralympic.ca/news/team-of-126-canadian-athletes-set-to-compete-at-paris-2024-paralympic-games/">126 athletes to the Paris Paralympics</a> to compete in 18 sports.</p> <p>Staff will be working hard to set up venues for the Paralympic sports. This means tearing down some temporary venues and putting up others that facilitate accessibility for Paralympic sports, athletes and their entourage.</p> <p>Transforming <a href="https://olympics.com/en/paris-2024/the-games/village">the village</a>, which housed just over 14,000 athletes and team personnel for the Olympics, to get it ready for the 8,000 para athletes and staff for the Paralympic Games is no simple feat.</p> <h2>A logistical nightmare</h2> <p>At this juncture, the question often arises as to why the Olympics and Paralympics aren’t combined together into one Games. The reasoning behind the decision is more complicated than it might appear.</p> <p>In 2001, the International Olympic Committee and the International Paralympic Committee signed the <a href="https://www.paralympic.org/feature/2-historic-one-bid-one-city-agreement">One Bid, One City</a> agreement to protect the interests of the Paralympic Games. The agreement requires host cities to stage both the Olympic and Paralympic Games using the same venues, facilities and infrastructure. This also unites the two sporting movements.</p> <p>The sheer size of such an event would make it impossible for almost any city to host a single combined Olympic and Paralympic Games. Consider the logistics of an event that would include approximately 15,000 athletes over 50 sporting disciplines.</p> <p>In the current iteration, there are already 15 cities outside of Paris playing host to events. For instance, sailing was <a href="https://olympics.com/en/paris-2024/venues/marseille-marina">held in Marseille</a>, shooting was <a href="https://olympics.com/en/paris-2024/venues/chateauroux-shooting-centre">held in Châteauroux</a> and the rowing and canoe-kayak events were <a href="https://olympics.com/en/paris-2024/venues/vaires-sur-marne-nautical-stadium">held in Vaires-sur-Marne</a>. Even a city with the resources and infrastructure of Paris could not, and would not, host an event of that size.</p> <p>Combining the games would necessitate a change in structure, and inevitably sports — likely Paralympic sports — would be dropped. Hence the two-week break between Games.</p> <h2>Paralympics deserve their own spotlight</h2> <p>The discussion about the separation of the two events goes much deeper than logistical concerns. Some supporters of the Paralympic Games see the need and value for a <a href="https://time.com/7004176/olympic-paralympic-games-separate/">separate event</a> that showcases and highlights elite athletes with disabilities.</p> <p>IPC President Andrew Parsons, for example, argues that hosting the Paralympic Games separately <a href="https://www.insidethegames.biz/articles/1147694/merging-olympic-and-paralympic-games">focuses on their broader mission</a> of drawing attention to “issues of disability rights, accessibility, and broader areas of inclusion for the legacy of the event.”</p> <p>The distinct Paralympic event showcases the elite performances of Para athletes, giving them the attention and celebration deserved. All too often, Para athletes’ successes are overshadowed by the <a href="https://doi.org/10.1177/21674795221103410">tendency of media to prioritize non-disabled athletes</a>, often marginalizing or overlooking the achievements of athletes with disabilities.</p> <p>The challenge, then, is for the host city to maintain the momentum from the Olympics and ensure Paralympic athletes receive the recognition they deserve for their sporting successes. The Canadian Paralympic Committee launched their <a href="https://paralympic.ca/games/paris-2024/">Greatness Moves Us</a> campaign recently to highlight the stories of excellence of Paralympic athletes and galvanize support and viewership.</p> <h2>A lasting legacy</h2> <p>Ultimately, the Paralympic Games showcase elite sporting excellence in a way that no other event does. But the Games are about so much more — championing inclusion, disability rights and a lasting legacy of social change.</p> <p>Paris is an example of a city that has stepped up to the challenge. It put <a href="https://www.nytimes.com/2024/05/06/travel/paris-olympics-accessibility-disabled.html">accessibility at the centre of its bid</a>, knowing full well the challenge ahead of them in the historic city.</p> <p>Leading into the Games, the city has made good on <a href="https://www.insidethegames.biz/articles/1147595/paris-accessibility-paralympics-games">many promises around accessibility</a> and increasing opportunities for people with disabilities. The city upgraded the overground transportation network by adding fully accessible bus and tram lines, and introduced 1,000 accessible taxis.</p> <p>They also tackled some challenging tasks, such as upgrading historic venues into accessible sporting spaces. More than €10 million was allocated to improve the accessibility of six major sports facilities, including the <a href="https://www.paris.fr/en/pages/georges-vallerey-swimming-pool-reopens-after-renovation-work-27046">Georges Vallerey swimming pool</a> and the <a href="https://www.paris.fr/en/pages/the-pierre-de-coubertin-stadium-has-been-renovated-for-the-olympic-games-27211">Pierre de Coubertin stadium</a>.</p> <p>The aim is to sustain the momentum, not only between the Olympic and Paralympic Games, but long after they conclude, with the goal of creating a more <a href="https://olympics.com/en/paris-2024/our-commitments/promoting-the-role-of-sports/more-inclusive-society">inclusive society</a> in France.</p> <p>Leading up to the start of the Paralympics, there is some concern about whether the momentum will be there from a viewership perspective and spectators in the stands. The Tokyo 2020 Paralympic Games set records for viewership in a Games that was largely devoid of spectators in the stand due to the COVID-19 pandemic.</p> <p>American <a href="https://www.wkar.org/wkar-news/2022-01-17/opinion-sports-are-a-shared-human-experience-bringing-us-joy-and-drama-so-it-is-time-to-appreciate-the-paralympics-on-par-with-the-olympics">television network NBC</a> reported 15.5 million viewers per night for the 2020 Olympic Games, in contrast to 14 million viewers in total for the 2020 Paralympic Games.</p> <p>But many of us will be looking more at the momentum of the event to be a catalyst for inclusion, access and opportunity beyond the events. Once all the lights go out on the Games, it is the lasting legacy of social change that will be the ultimate judge of the success of both the Olympic and Paralympic Games.<!-- Below is The Conversation's page counter tag. <p dir="ltr">A group of travel experts have shared their holy grail hacks to transform your next holiday. </p> <p dir="ltr">From the best days to book your flights, to how to score an upgrade at a hotel, these seasoned travellers told the <em><a href="https://www.dailymail.co.uk/travel/article-13772593/Twenty-one-travel-hacks-transform-holiday-trick-getting-hotel-upgrade-cheapest-days-book-flights-expert-advice-Mails-experts.html">Mail Online</a></em> how to get the most out of your next trip. </p> <p dir="ltr"><strong>Pay in the local currency </strong></p> <p dir="ltr">When you make a transaction via card in a foreign country, EFTPOS machines will often prompt you if you want to pay in your home currency or the local currency. </p> <p dir="ltr">By opting for the local currency, you can avoid potentially unfavourable currency conversions made by retailers, as the transaction will be made according to the standard daily rates set by Visa or MasterCard.</p> <p dir="ltr">Likewise, if withdrawing currency from a foreign ATM, always select the local currency to avoid paying the Dynamic Currency Conversion (DCC), which is effectively a way to squeeze more cash out of unwitting customers.</p> <p dir="ltr"><strong>Book a midweek flight </strong></p> <p dir="ltr">Travellers are usually keen to book flights between Thursday and Monday to line up with the beginning and end of the week. </p> <p dir="ltr">However, flights booked midweek, especially from Monday to Wednesday, are consistently around 20-30 per cent less than at the weekend.</p> <p dir="ltr"><strong>Connect with an eSim card</strong></p> <p dir="ltr">To avoid extortionate overseas data roaming charges, those travelling abroad should invest in an eSim card to keep using your phone on holiday. </p> <p dir="ltr">An eSim is cheaper and less hassle than dealing with buying an international physical Sim card, and can be changed for the best fees depending on regions.  </p> <p dir="ltr"><strong>Book your hotel direct </strong></p> <p dir="ltr">Many travellers opt to book their accommodation through a third-party after being enticed by deals, book now pay later schemes, or the abundance of options. </p> <p dir="ltr">However the <em>Daily Mail’s </em>Inspector hotel reviewer says “it almost always pays” to call and say you have seen a price that is lower than on the hotel’s website elsewhere.</p> <p dir="ltr">“Quite often you will get a lower rate, or an upgrade or a complimentary bottle in your room or a voucher for a drink at the bar,” the reporter says.</p> <p dir="ltr">By calling the hotel and asking them to match a price found on a third party site, you can often score the lower price, and even a better room. </p> <p dir="ltr"><strong>Never use airport currency exchange booths</strong></p> <p dir="ltr">Currency exchange booths at airports are notorious for jacking up their conversion fees, meaning unsuspecting travellers can pay more to get their own money. </p> <p dir="ltr">It’s best not to leave cash conversion until the last minute. Restaurant charges diners $95 to slice up birthday cake

<p>A restaurant in Italy has been slammed online after charging a group of diners a hefty cost to simply cut a birthday cake into slices. </p> <p>A family attended the high-end restaurant in the southern area of ​​Arezzo to celebrate their mother's birthday, after they had asked the restaurant in advance if they could bring in an outside cake.</p> <p>After enjoying their meal, which came to a whopping €659 or $1,083 AUD, they were slapped with another fee of €58 or $95 to cut the cake and bring it to the table.</p> <p>Local news outlet <em><a href="https://corrierefiorentino.corriere.it/notizie/24_agosto_26/arezzo-ristorante-chiede-58-euro-solo-per-tagliare-la-torta-lo-scontrino-diventa-virale-e-il-gestore-quasi-si-scusa-267975fd-2227-4beb-9621-3bffb3aa4xlk.shtml" target="_blank" rel="nofollow noopener">Corriere Fiorentino</a></em> reported that the cost of slicing the cake was more than the cake itself.</p> <p>Two of the dinner guests shared the story of the expensive fee on a local Facebook page, claiming the restaurant said it is the rule of their establishment and they were required to pay it. </p> <p>The owner of the restaurant told the Italian media site, "We do not charge a cover charge and we mainly serve dishes of our own production, so we try to discourage those who bring things from outside." </p> <p>"If we consider that in Arezzo the average cover charge is 2.5 euros per person, there is not such a big difference," they said as they explained the group of diners was 13 people. </p> <p>"My restaurant has to pay for the waiter who serves at the table, the dishwasher and other related services. Boy accidentally smashes 3500-year old artefact

<p>A 3500-year old jar has been smashed to pieces after a four-year-old boy accidentally knocked it over during a trip to a museum in Israel. </p> <p>The Hecht Museum in Haifa told the BBC that the artefact dates back to the Bronze Age between 2200 and 1500BC - and was considered a rare find because it was so intact.</p> <p>It had been on display near the entrance of the museum without any protective glass around it, as the museum believes there is a  “special charm” in showcasing archaeological finds “without obstructions”.</p> <p>The boy's father, Alex, told the publication that his son had only "pulled the jar slightly" because he was "curious about what was inside", causing it to fall.</p> <p>He also said that he was "in shock" to see his son next to the ruined artefact and initially thought "it wasn't my child that did it".</p> <p>After calming his child down, he spoke to a security guard who confirmed what happened. </p> <p>The museum stated they would not be charging the family and they've even invited the child back to the exhibition for an organised tour after the incident occurred a few days ago. </p> <p>“There are instances where display items are intentionally damaged, and such cases are treated with great severity, including involving the police,” Lihi Laszlo from The Hecht Museum told the <em>BBC</em>. </p> <p>“In this case, however, this was not the situation. The jar was accidentally damaged by a young child visiting the museum, and the response will be accordingly.”</p> <p>A conservation specialist has also been brought on board to restore the jar, which will be returned to the museum "in a short time".</p> <p>The boy's father said they will feel "relieved" to see the jar restored but added they are "sorry" because "it will no longer be the same item". </p> <p>“Despite the rare incident” the museum told the publication that they intend to continue displaying items without barriers or glass walls, where possible. </p> <p>The ancient jar was likely originally used to carry local supplies like wine and olive oil and predates the time of the Biblical King David and King Solomon and is distinctive of the Canaan region on the eastern Mediterranean coast.</p> <p><em>Images: Hecht Museum</em></p> <p> </p>

Dad fined $1,200 for 'critical' seatbelt mistake

<p>At the start of last month, Queensland authorities increased driving fines to a record high, with the value of a penalty unit increasing by 4.2 per cent. </p> <p>One Aussie dad found out the hard way this week after he copped a $1,209 fine when he was stopped by police during a traffic operation as part of the state's Road Safety Week and found that his two kids did not have their seatbelts fixed correctly. </p> <p>They found the 5-year-old boy not properly secured in his booster seat, while a 6-year-old boy, who was seated in the right-side back seat, was found to have the middle seat belt wrapped around his neck.</p> <p>The hefty fine also comes with 4 demerit points. </p> <p><span style="font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen, Ubuntu, Cantarell, 'Open Sans', 'Helvetica Neue', sans-serif;">Queensland Police</span><span style="font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen, Ubuntu, Cantarell, 'Open Sans', 'Helvetica Neue', sans-serif;"> </span>have warned their motorists about increased police vigilance on their roads. </p> <p>"Failure to wear a seatbelt is one of the leading causes of road crash deaths. Unrestrained drivers and passengers are eight times more likely to be killed in a road crash," Acting Inspector Kylie Doyle said. </p> <p>"If this driver had been in a crash, it would have likely resulted in significant, possibly life-threatening injuries for these children."</p> <p>Following the state's move to increase the value of a penalty unit, drivers caught using their phone or not wearing a seatbelt properly will now pay a fine of over $1,200. </p> <p>Drivers caught speeding more than 30km/h over the speed limit are also forced to pay over $1,200. </p> <p>Based off the average salary in the state, this means that drivers caught for such infringements would be paying around 65 per cent of their weekly salary on the fine. </p> <p>Authorities across the country have been cracking down on driver misbehaviour in attempt to reduce the number of road fatalities. </p> <p>"It is critical we all play our part to be safer on Queensland roads," Acting Inspector Kylie Doyle warned motorists on Tuesday.</p> <p><em>Image: S</em><em>ongsook / Shutterstock.com</em></p>

Even after the government’s aviation crackdown, Australia will lag behind on flyers’ rights

<div class="theconversation-article-body"><em><a href="https://theconversation.com/profiles/ian-douglas-2932">Ian Douglas</a>, <a href="https://theconversation.com/institutions/unsw-sydney-1414">UNSW Sydney</a></em></p> <p>When it comes to consumer protections for airline passengers, Australia has long been dragging its feet.</p> <p>The limited protections we do have rely heavily on the general <a href="https://consumer.gov.au/index.php/australian-consumer-law">Australian Consumer Law</a>. The “consumer guarantees” provided in this law only require services to be delivered in the arguably vague framework of a “reasonable time”.</p> <p>That might be okay if we’re just getting a sofa delivered from a furniture retailer. The cost of a late delivery is low.</p> <p>But these guarantees were not tailored to the unique impacts delayed or cancelled flights can have on travellers. Australia’s lack of aviation-specific protections has long been a severe <a href="https://www.accc.gov.au/system/files/Airlines%20Terms%20and%20Conditions%20Report.pdf">pain point</a> for flyers, only heightened by pandemic disruption.</p> <p>The government’s much-awaited <a href="https://www.infrastructure.gov.au/infrastructure-transport-vehicles/aviation/aviation-white-paper">Aviation White Paper</a>, released in full on Monday, promised to address this issue. At the heart of the reforms, Australia will get a new aviation ombud scheme, and a new charter of customer rights for passengers.</p> <p>The recognition that new protections are needed is a step in the right direction. But this once-in-a-generation white paper missed the chance to achieve far more, by moving Australia to the style of consumer protection that have now been offered for 20 years in <a href="https://www.airhelp.com/en-int/ec-regulation-261-2004/">Europe</a>.</p> <h2>Why is air travel unique?</h2> <p>Airline customers have a reasonable expectation of arriving at their destination, at (or close to) the time published by the airline in its schedule at the time the reservation was paid and ticketed.</p> <p>If this can’t be achieved, they should at least arrive at some amended time that was advised far enough in advance to allow related reservations and bookings to be adjusted.</p> <p>Air travel has to be punctual because it doesn’t have any substitutes. On even a modest deadline, driving from Perth or even Sydney to Melbourne, for example, is not a comparable option.</p> <p>And a passenger’s options to adapt their travel plans diminish as the departure date approaches. In the final days before travel, hotel cancellation deadlines pass and alternative connecting flight options sell out or spike in price.</p> <p>In some cases, travelling to a specific event can become pointless for a passenger if a delay is lengthy enough.</p> <h2>Australia is playing catch-up</h2> <p>In contrast with Australia, aviation-specific protections have long existed in many other developed economies.</p> <p>In the European Union (EU), for example, <a href="https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=LEGISSUM%3Al24173">regulations</a> make clear that airlines have specific obligations and responsibilities in the event of delays, cancellations and denied boardings. This includes the <a href="https://www.airhelp.com/en-int/ec-regulation-261-2004/">right to compensation</a> of up to €600 (A$988).</p> <p>These protections and the levels of compensation payable for failure to meet specified requirements for different kinds of flights are comprehensively legislated.</p> <p>Canada has a <a href="https://laws-lois.justice.gc.ca/eng/regulations/SOR-2019-150/index.html">slightly different approach</a> – smaller regional carriers have different obligations to mainline operators. But as with the European regulation, it imposes an obligation to get the passenger to the ticketed destination, or to refund the ticket if the journey has become pointless.</p> <p>The absence of such legislated protections in Australia means we typically have to rely on the goodwill of the airline when things go wrong.</p> <h2>Real action has been delayed</h2> <p>The centrepiece proposal of the <a href="https://www.infrastructure.gov.au/infrastructure-transport-vehicles/aviation/aviation-white-paper">white paper</a> is to create a new ombud scheme with “the power to direct airlines and airports to provide remedies to consumers and investigate customer complaints about airlines’ and airports’ conduct”. This will replace the existing <a href="https://www.airlinecustomeradvocate.com.au/General/Default.aspx">Airline Customer Advocate</a>.</p> <p>A new charter of customer rights, to be produced by the scheme, will aim to give flyers “greater certainty about what they can expect when flights are cancelled and delayed” and require airlines to be more transparent about their performance.</p> <p>The white paper noted the poor on-time performance of Australian carriers. It also pointed out that the Australian Competition and Consumer Commission <a href="https://www.accc.gov.au/system/files/Airlines%20Terms%20and%20Conditions%20Report.pdf">identified</a> problems with consumer protections for air travel in Australia as far back as 2017. But its proposals offer no real quantifiable or enforceable improvements to consumer rights.</p> <p>Despite the well-established models in comparable countries – many of which have <a href="https://theconversation.com/if-australia-had-an-aviation-ombudsman-passengers-could-get-compensation-for-cancelled-flights-235679">followed the EU’s lead</a> – Australians will need to wait for yet another discussion process to be complete before they see what protections may eventually be introduced.</p> <p>The government’s white paper has largely just kicked the can down the road.</p> <p>At a minimum, passengers on Australian carriers deserve the assurances given to those travelling in and from Europe: in the event of a cancellation or long delay, that they will be transported to their destination on an alternative flight as quickly as possible.</p> <p>They should also be given appropriate meals and accommodation until they can make this onward journey, receive compensation for lengthy delays, and have the option to return home with a full refund if their travel has become pointless.<!-- Below is The Conversation's page counter tag. Why is it so hard to cancel subscriptions or end ‘free’ trials? Report shows how companies trap you into paying

<div class="theconversation-article-body"><em><a href="https://theconversation.com/profiles/katharine-kemp-402096">Katharine Kemp</a>, <a href="https://theconversation.com/institutions/unsw-sydney-1414">UNSW Sydney</a></em></p> <p>Many businesses are trapping Australian consumers in paid subscriptions by making them hard to cancel, hiding important details and offering “free” trials that auto-renew with hefty charges. We need law reform to tackle this continuing problem.</p> <p><a href="https://cprc.org.au/report/let-me-out">A new report</a> shows 75% of Australian consumers have had negative experiences when trying to cancel a subscription, according to the Consumer Policy Research Centre (CPRC).</p> <p>It shows businesses use “<a href="https://www.wired.com/story/how-to-spot-avoid-dark-patterns/">dark patterns</a>”, which are designs that hinder consumers who try to act in their own best interests. Subscription traps are often called “<a href="https://www.ftc.gov/business-guidance/blog/2022/11/checking-out-ftcs-100-million-settlement-vonage">Hotel California</a>” techniques, referring to The Eagles’ famous lyric: “you can check out any time you want, but you can never leave”.</p> <p>In some of these cases, consumers may have remedies under our existing consumer law, including for misleading conduct. But we need law reform to capture other <a href="https://treasury.gov.au/consultation/c2023-430458">unfair practices</a>.</p> <p>In the meantime, the CPRC’s research also gives examples of businesses with <em>fair</em>, consumer-friendly subscription practices. These also benefit the business.</p> <h2>Examples of unfair subscription traps</h2> <p><a href="https://www.forbes.com/councils/forbesbusinessdevelopmentcouncil/2022/09/12/the-evolution-of-the-subscription-model-and-whats-on-the-horizon/">Subscription business models</a> have become common – many products are now provided in the form of software, an app or access to a website. Some do this by allowing consumers to start a subscription with a single click, but creating multiple obstacles if you want to end the subscription.</p> <p>This can include obscuring cancellation options in the app, requiring consumers to phone during business hours or making them navigate through multiple steps and offers before terminating. The report points out many of the last-ditch discounts offered in this process are only short term. One survey respondent said:</p> <blockquote> <p>I wasn’t able to cancel without having to call up and speak to someone. Their business hours meant I had to call up during my work day and it took some time to action.</p> </blockquote> <p>Other businesses badger consumers with frequent emails or messages after they cancel. One respondent said a business made “the cancellation process impossible by making you call and then judging your reason for cancellation”.</p> <h2>What does consumer law say?</h2> <p>Some subscription traps already fall foul of the Australian Consumer Law and warrant investigation by the <a href="https://www.accc.gov.au/media-release/accc-warns-consumers-to-beware-of-subscription-traps">Australian Competition &amp; Consumer Commission</a> (ACCC). Consumers may have remedies where the business has engaged in misleading conduct or imposes an unfair contract term.</p> <p>For example, the ACCC is <a href="https://www.accc.gov.au/media-release/accc-court-action-against-eharmony-for-alleged-misleading-online-dating-membership-statements#:%7E:text=The%20ACCC%20has%20today%20commenced%20proceedings%20in%20the,the%20pricing%2C%20renewal%20and%20duration%20of%20its%20memberships.">suing dating site eHarmony</a> for its allegedly misleading subscription practices.</p> <p>In the United States, the Federal Trade Commission <a href="https://www.ftc.gov/news-events/news/press-releases/2024/06/ftc-takes-action-against-adobe-executives-hiding-fees-preventing-consumers-easily-cancelling">has filed a complaint against software company Adobe</a> for allegedly using dark patterns in its subscription practices.</p> <p>The Federal Trade Commission has alleged that “Adobe pushed consumers toward the ‘annual paid monthly’ subscription without adequately disclosing that cancelling the plan in the first year could cost hundreds of dollars”.</p> <p>Adobe <a href="https://news.adobe.com/news/news-details/2024/Adobes-Recent-Statement-Regarding-Updated-Federal-Trade-Commission-Complaint-/default.aspx">issued a statement</a> arguing the commission’s complaint “mischaracterises” its business. The litigation is ongoing.</p> <h2>We need an unfair practices prohibition</h2> <p>Some subscription traps would fall outside the existing consumer law. For instance, the habit change app Atoms (based on James Clear’s book Atomic Habits) has a genuinely free trial. It doesn’t require credit card details, doesn’t auto-renew, and lets consumers know how many trial days remain.</p> <p>The CPRC says the charity World Vision doesn’t auto-renew annual sponsorships, but reminds supporters about when the sponsorship will lapse.</p> <p>Importantly, some businesses – such as Netflix – use their data for good in this context. They notice when users are paying for the service without using it and help them unsubscribe.</p> <p>These practices should be applauded. But we need an unfair practices prohibition for businesses who don’t follow suit and recognise the long-term benefits of treating customers fairly.<!-- Below is The Conversation's page counter tag.
