Can you change your mind after you buy a house?

<div class="theconversation-article-body"> <p><em><a href="https://theconversation.com/profiles/rosemary-gibson-1544081">Rosemary Gibson</a>, <a href="https://theconversation.com/institutions/the-university-of-queensland-805">The University of Queensland</a></em></p> <p>In the Bluey episode “<a href="https://iview.abc.net.au/show/bluey-the-sign">The Sign</a>”, the Heeler family enters a contract to sell their family home to a pair of English Sheepdogs, or as Bluey calls them, “the dogs with no eyes”.</p> <p>But towards the end of the episode, the Sheepdogs spy another house that they prefer. Unlike Bluey’s house, the new place has a pool.</p> <p>They telephone Bandit and tell him that they have changed their mind. Happily for Bluey’s family – and let’s face it, most of Australia – Bandit decides not to press ahead with the sale and the Heelers end up staying put in their family home.</p> <p>But aside from the fact that the contracting parties are all cartoon dogs – how realistic is this scenario? Is it possible to end a contract to purchase or sell a house simply because you’ve changed your mind?</p> <p>The reality is that once a contract of sale is signed, there are only limited circumstances in which buyers and sellers can bring the contract to an end.</p> <h2>What do you sign when buying or selling a house?</h2> <p>In Australia, each state and territory has its own standard form contract for the sale of land that buyers and sellers must sign.</p> <p>The terms of these contracts mirror relevant state or territory laws, meaning they differ throughout Australia. It is important for parties to obtain advice from a property lawyer with experience in a particular jurisdiction’s contract.</p> <h2>Can you change your mind after signing?</h2> <p>Once a contract has been signed, a buyer may only end it for a “change of mind” during the “cooling off period”. The cooling off period is a short period of time – usually between two and five business days – after the contract is signed.</p> <p>During this time, the buyer can end the contract, “no questions asked”. But there are usually financial consequences for terminating during the cooling off period.</p> <p>For example, in New South Wales, Queensland and the ACT, a buyer who ends the contract during the cooling off period must pay the seller 0.25% of the purchase price. For a house purchase of A$1 million, this termination penalty would be $2,500.</p> <p>But not all states and territories guarantee a cooling off period for buyers. And in such a hot property market, an individual seller may be unlikely to agree to include such a term in a contract.</p> <h2>What if something goes wrong down the track?</h2> <p>When negotiating the contract terms, the parties may agree that the sale is subject to certain conditions. Typically, these conditions are in the purchaser’s favour. If one of the conditions is not satisfied in time, then the contract can be brought to an end.</p> <p>It is up to the parties to negotiate which conditions (if any) are included in the contract, and the time by which the conditions must be satisfied. The most common conditions of sale are:</p> <ul> <li>the buyer obtains finance by a certain date (a finance clause)</li> <li>the buyer obtains satisfactory building and pest inspection reports by a certain date (a building and pest clause).</li> </ul> <p>The buyer may also want the sale to be subject to the buyer first selling an existing property.</p> <p>Once all of the conditions of sale are satisfied, the contract is said to be “unconditional”. From this time, there are no express circumstances in which either party may bring the contract to an end.</p> <p>When the Sheepdogs telephoned Bandit, the Heelers had already moved all their furniture out of the house. Clearly, the sale had already gone unconditional. There was no express basis on which the Sheepdogs could have terminated the contract.</p> <h2>Could the Heelers have sued for breach of contact?</h2> <p>A party who ends a contract without justification is liable to pay compensation to the other party.</p> <p>A house purchaser who wrongly terminates a contract would almost certainly lose their deposit. They may also be liable for additional losses the seller suffers as a result of the breach, including any deficiency in price on a resale of the property.</p> <p>But a buyer and seller may bring a contract to an end by “mutual agreement”, which seems to be what happened in Bluey. The Sheepdogs sought to end the contract and – to the relief of all Australians – the Heelers agreed.</p> <p>This is, however, unlikely to occur “in real life”, especially in today’s highly competitive property market.</p> <p>At the very least, the seller would be entitled to retain the purchaser’s deposit. There would also be the issue of who bears the costs incurred in advertising and agency fees.</p> <p>It seems Bandit followed his heart rather than the strict terms of the contract — and Australia is the better for it.<!-- Below is The Conversation's page counter tag. King Charles shares cheeky message to England football team

<p>King Charles has shared a cheeky message to England's football team after their semi-final win, securing a spot in the UEFA grand final.</p> <p>The monarch congratulated the team for their win over The Netherlands, while issuing some quick-witted advice ahead of the final game on Sunday. </p> <p>Referencing their recent nail-biting goals during the football tournament, being played in Germany, the King asked them to wrap up the win earlier in the game.</p> <p>"My wife and I join all our family in wishing you the warmest congratulations on reaching the final of the UEFA European Championship - and in sending our very best wishes for Sunday's match," the King wrote.</p> <p>"If I may encourage you to secure victory before the need for any last minute wonder-goals or another penalties drama, I am sure the stresses on the nation's collective heart rate and blood pressure would be greatly alleviated!"</p> <p>His Majesty wished "good luck, England" before signing off with a "Charles R" at the bottom of the letter to England team manager Gareth Southgate and his team. </p> <p>The monarch wasn't the only one to react to the win, Prince William also posted a message on social media sharing his congratulations to the national team. </p> <p>"What a beauty, Ollie! “Don’t marry him”: Bride-to-be shares wild altercation with her future in-laws over her wedding dress

<p dir="ltr">A woman has been told to “run” from her fiancé after sharing a wild conversation she had with her future in-laws about her wedding dress. </p> <p dir="ltr">The bride-to-be shared that ever since she was a child, she wanted to wear her mother’s wedding dress on her own big day. </p> <p dir="ltr">However, the woman was then confronted by her soon-to-be in-laws, with drama ensuing over her wedding dress.</p> <p dir="ltr">Taking to Reddit’s “Am I The A**hole?” page, the woman explained, "My mother's wedding dress has been passed down for generations and I remember being a little girl dreaming of walking down the aisle in it."</p> <p dir="ltr">Despite her wishes to wear the family heirloom on her big day, she said things went south at a dinner at her sister-in-law’s (SIL) house when she  "tapped her spoon against the glass and said that she had to make a toast."</p> <p dir="ltr">"She then said she would be right back before going into another room and returning with a large plastic bag," the bride continues.</p> <p dir="ltr">"Everyone seemed to be excited but I just felt confused."</p> <p dir="ltr">As she "awkwardly smiled", her SIL opened the bag to reveal her wedding dress from her wedding two years earlier as her in-laws began clapping, as her future sister-in-law announced she wanted the bride to wear her dress at her upcoming nuptials.</p> <p dir="ltr">"I tried to smile but I guess I didn't do a good job of hiding my disappointment and everyone began asking me what was wrong," the bride-to-be continues, adding that she tried to explain that she wanted to wear her mother's wedding dress.</p> <p dir="ltr">At this point, her SIL began to cry and her in-laws began berating her, causing the bride to burst into tears and run outside.</p> <p dir="ltr">"My fiancé didn't even come after me and after crying my eyes out on the steps for what felt like hours, he finally came outside and yelled at me to get into the car," she says.</p> <p dir="ltr">Confused, she got into the car only for her fiancé to berate her for making "such a big scene" leaving him feeling "embarrassed in front of his family."</p> <p dir="ltr">"He sounds so mad and he even said he couldn't believe he chose to marry such a 'bitchy c--t' (his exact words)."</p> <p dir="ltr">The woman tried to explain how important it was to her to wear her mother's dress and that she had already promised her mother she would be wearing it on her big day.</p> <p dir="ltr">"I felt like my fiancé's family planned this and put me on the spot thinking I wouldn't stand up for myself and just agree to wear SIL's dress," she continues.</p> <p dir="ltr">"I don't think I did anything wrong but a part of me thinks I should have just gone along with it and then told SIL in private that I wouldn't be wearing the dress."</p> <p dir="ltr">Hundreds of people were quick to comment on her post, suggesting that she “run” not only from her in-laws, but from her partner as well. </p> <p dir="ltr">"Ma'am you need to leave that whole family behind including your fiancé," one said. Bon Jovi shares sad family news

<p>Jon Bon Jovi's mother, Carol Bongiovi has died aged 83, just three days before her birthday. </p> <p>Carol passed away at Monmouth Medical Center in Long Branch, New Jersey, on Tuesday.</p> <p>The star paid a heartbreaking tribute to her, telling <em>People</em>: “Our mother was a force to be reckoned with, her spirit and can-do attitude shaped this family.”</p> <p>“She will be greatly missed.”</p> <p>No cause of death has been given. </p> <p>Carol affectionally known to fans as "mum Jovi" was a former Playboy Bunny and the founder of the Bon Jovi band's official fan club. </p> <p>Jon previously spoke about his mother's influence on his career in a 2020 interview with <em>The Big Issue</em>. </p> <p>"What I got from my parents was the ability to make the dream reality," he explained. </p> <p>"Even if you truly weren't any good at your craft, if you believed you were, you could work on it. As I got older I realised that was a great gift that I got from my folks.</p> <p>"They truly believed in the John Kennedy mantra of going to the moon. 'Yeah, of course you can go to the moon. Just go, Johnny.' And there I went."</p> <p>He also shared a <a href="https://www.instagram.com/p/C9QAG10uRk-/" target="_blank" rel="noopener">clip</a> from his 2020 music video for <em>Story of Love </em>on Instagram, which featured his parents and captioned it: "Momma. We carry you with us. Tragic moment mother returns to scene of fatal house fire

<p>In a heartbreaking moment, Stacey Gammage, 29, has returned to her devastated home in Lalor Park for the first time since the tragic fire that claimed the lives of three of her children. The fire, allegedly <a href="https://www.oversixty.com.au/finance/legal/dean-heasman-s-grandmother-breaks-silence-after-deadly-house-fire" target="_blank" rel="noopener">started by her partner, Dean Heasman</a>, 28, left the family reeling with loss and sorrow.</p> <p>On Sunday, shortly before 1am, Heasman allegedly set the family’s home ablaze and barricaded them inside. Two boys, aged two and six, were critically injured and later died at Westmead Hospital. The body of a five-month-old girl was also found by firefighters after extinguishing the flames.</p> <p>Returning on Tuesday afternoon, Stacey Gammage, still wearing her hospital wristband, was supported by family members and police as she read the numerous tributes and cards left outside the home. The street was closed for almost two hours to allow her to grieve privately.</p> <p>The devastated mother then returned to Westmead Hospital, where her four surviving children remain. The children, including a nine-year-old girl and three boys aged four, seven and 11, are all reported to be in stable condition.</p> <p>Heasman remains under police guard in an induced coma at Westmead Hospital, and no charges have yet been filed. Investigations continue under Strike Force Carrbridge. According to reports, Heasman allegedly threw a burning pillow at his wife, which contributed to the blaze. Investigators are also examining whether an accelerant was used, as a second explosion occurred moments after the initial fire began.</p> <p>Local hero Jarrod Hawkins, whose daughter is friends with one of the surviving children, rushed to the burning home and saved the nine-year-old girl and her three brothers. The eldest boy reportedly told his rescuers, "Dad tried to kill me."</p> <p>As the community mourns this unimaginable loss, they continue to leave floral tributes, stuffed toys, and candles at the scene, while detectives work tirelessly to uncover the full details of the tragedy.</p> <p><em>Image: Nine News</em></p>

Dean Heasman's grandmother breaks silence after deadly house fire

<p>The estranged and terminally-ill grandmother of the man allegedly responsible for lighting a house fire that killed three of his children has spoken out in the wake of the tragedy. </p> <p>In the early hours of Sunday morning, neighbours raised the alarm after spotting the fire in a family home in the suburb of Lalor Park, with firefighters arriving on the scene in six minutes to battle what neighbours called an "intense" <a href="https://oversixty.com.au/finance/legal/three-children-dead-after-allegedly-being-forced-into-house-fire" target="_blank" rel="noopener">blaze</a>. </p> <p>Two boys aged three and six years old were given CPR on the street but could not be revived, and a 10-month-old baby girl was also found dead inside the home.</p> <p>The children's father, Dean Heasman, has since been arrested over the deaths of the children, with police treating the tragedy as a domestic violence attack.</p> <p>Now, Heasman's grandmother, 82-year-old Neryle Heasman, told <a href="https://www.dailymail.co.uk/news/article-13610539/Lalor-Park-house-fire-dean-heasman.html" target="_blank" rel="noopener"><em>Daily Mail Australia</em></a> she knew her grandson Dean as "a nice child" but said she had been estranged from him in recent years.</p> <p>"I didn't have a lot to do with him since his father, my son also named Dean, passed away," she said.</p> <p>"On the odd occasion I saw him, I remember him being a nice child."</p> <p>Mrs Heasman, who is receiving home palliative care for terminal lung cancer and has six months to live, said she had not met her great-grandchildren.</p> <p>"I have kept up with his family through photos on Facebook," she said.</p> <p>But she was stunned to discover he was at the centre of the police investigation into the deadly fire, asking <em>Daily Mail Australia</em>, "Are you sure we're talking about the same Dean?"</p> <p>A 29-year-old woman, a nine-year-old girl, and three boys aged four, seven and 11 were also in the house during the blaze, but escaped and were rushed to Westmead hospital. </p> <p>Investigators are now trying to determine what caused the blaze, with reports claiming that Heasman threw a pillow on fire at his partner, which was partially responsible for starting the fire. </p> <p><em>Image credits: 7News / Daily Mail Australia </em></p>

<p>Rod Stewart has shared the secret behind his 17-year marriage with Penny Lancaster, and how the couple continue to make their relationship work. </p> <p>Chatting candidly with <a href="https://www.hellomagazine.com/celebrities/704566/rod-stewart-penny-lancaster-secret-to-their-happy-marriage/" target="_blank" rel="noopener"><em>Hello!</em></a> magazine, Stewart, 79, and Lancaster, 53, shared their ultimate secret to a happy and prosperous marriage.</p> <p>"We love life and make date nights for one another, among touring and family time," the rockstar told the publication.</p> <p>"We listen to each other and try to resolve all our disagreements, the dirty laundry as Penny says, right away, and before we go to bed."</p> <p>After a career spanning 62 years, Stewart says he has no desire to slow down and stop performing, while his wife says she admires her husband's drive and work ethic. </p> <p>"He loves what he does so much and will never retire. He's a workaholic and constantly on the move," she said.</p> <p>Stewart went on to say that despite his love of performing, he has learned to balance work and family.</p> <p>"I used to be much more preoccupied with myself and my career. But I've learnt from my mistakes and am more present," he said.</p> <p>The couple first met when Lancaster when she was hired to photograph Stewart on a tour in the '90s.</p> <p>"When we first met, I got her phone number – I had just broken up. <p><em><strong>Warning: This article contains disturbing content that readers may find distressing. </strong></em></p> <p>Three children have tragically died in a house fire in Sydney's west, with police allegedly treating the incident as a domestic violence attack. </p> <p>At 1am on Sunday morning, neighbours raised the alarm after spotting the fire in a family home in the suburb of Lalor Park.</p> <p>Firefighters arrived on the scene in six minutes to battle what neighbours called an "intense" blaze. </p> <p>"The flames were shooting out the front window at 20 feet," Brett said.</p> <p>Two adults and seven young children were inside when the fire broke out, with neighbours saying they were awoken by screaming. </p> <p>Two boys aged three and six years old were given CPR on the street but could not be revived, and a 10-month-old baby girl was also found dead inside the home.</p> <p>As rescue crews, emergency services and locals battled to extinguish the powerful flames and rescue those inside, father Dean Heasman was allegedly seen pushing the children back in.</p> <p>"We're alleging that 28-year-old man took direct actions to prevent the rescue of those young lives that were lost," NSW Police Homicide Squad Superintendent Danny Doherty said.</p> <p>"We will allege that this 28-year-old man's actions were directly the cause of the death of these three young people."</p> <p>"We've seen three young lives have just been taken away in the most tragic of circumstances, quite unimaginable how the family is coping with this."</p> <p>A 29-year-old woman, a nine-year-old girl, and three boys aged four, seven and 11 were also in the house during the blaze, but escaped and were rushed to Westmead hospital. </p> <p>Neighbours said the surviving children told them the man ordered them to stay inside the home as it burned, one of them claiming he tried to fight in a bid to save his siblings.</p> <p>"Dad tried to kill us," the child allegedly told rescuers.</p> <p>Residents claimed they saw the man attempting to drag the terrified children back inside, as they said he was shouting "leave me here to die".</p> <p>It's understood the man, who was arrested at the scene and remains in a coma with significant injuries, was not previously known to police and had no existing apprehended violence order against him.</p> <p>NSW Premier Chris Minns labelled the incident "horrifying and senseless" and offered the family support, as an investigation into the cause of the blaze begins. </p> <p><em>Image credits: Nine News</em></p> <p> </p>

Indigenous netball player shares "disgusting" hate letter after sponsorship drama

<p>An Indigenous netball star has shared a vile hate letter she received from a netball fan, two years on from the Netball Australia sponsorship drama.</p> <p>Prior to her first game with the Australian Diamonds national team in 2022, Donnell Wallam, a Noongar woman from Western Australia, refused to wear the uniform which featured the logo of Gina Rinehart’s Hancock Prospecting.</p> <p>The 30-year-old athlete shared that her reasoning was over racist comments made by Rinehart's late father in the 1980s, when he suggested Aboriginal people should be sterilised.</p> <p>In response to Wallam's boycott, Gina Rinehart dramatically tore up her $15 million sponsorship deal with Netball Australia, which had been set to run until the end of 2025.</p> <p>Now, two years on from the sponsorship drama, Wallam shared a photo on of hate mail she received about the controversy, from a woman named “Mary”.</p> <p>The letter posted to Instagram, which accused Wallam of being "radicalised by the Aboriginal left", includes a mocking imitation of an Indigenous Acknowledgement of Country paying “respects to British and European elders”.</p> <p>“As if the hate online wasn’t enough, Mary thought she’d send me a letter,” the netballer wrote. “I’m beyond disgusted and hurt but I will never stop advocating for my people. Blak, Loud and Proud. ALWAYS.”</p> <p>The letter reads, “I am writing to you to express my sadness that your [sic] cost the Australian Diamonds, of $15,000,000, caused by your radically influenced comments about Gina Rinehart’s father, Lang Hancock.” </p> <p>“Mr Hancock’s comments about serialisation [sic] of Aboriginals was disgusting and made by one man. However, at the time his daughter was not yet born as you were not yet born. You were influenced by the nasty activist Aboriginal clique that hates everything Australia. You fell into their spell and caused such loss of donations to Australia Netball. "A bit grim": Sam Neill shares cancer update

<p>Actor Sam Neill has shared a heartbreaking update on his cancer journey, which he has said he will eventually succumb to. </p> <p>Last year, the 76-year-old revealed that he was battling rare blood cancer, angioimmunoblastic T-cell lymphoma.</p> <p>After undergoing chemotherapy that failed to work, Neill's doctor switched him to an anti-cancer drug which has put him in remission for more than 12 months. </p> <p>The treatment requires him to have infusions every two weeks, and while his condition is currently stable, the drug will eventually stop working. </p> <p>Speaking candidly to the <em>Herald Sun</em> about his condition, he said while he is maintaining a positive outlook, the gruelling treatment is impacting the way he lives his life.</p> <p>“It’s just meant that every second week it was a case of forget about the weekend because that would be a bit grim,” he explained of his treatment schedule. “But other than that, it’s great to be alive and working and in beautiful places, like York.”</p> <p>Last year, Sam insisted while he wasn’t afraid of death after battling the disease, he “would be annoyed” because he still has plenty he wants to achieve.</p> <p>“I’m prepared for that,” Neill said at the time, adding that while dying would be “annoying” he’s not “remotely afraid” of it.</p> <p>“The last thing I want is for people to obsess about the cancer thing because I’m not really interested in cancer," he added. <p>Princess Eugenie has shared a lengthy tribute to her mother Sarah Ferguson for believing her pain as a child that led to her scoliosis diagnosis. </p> <p>The royal shared a sweet photo from her childhood, showing her in a school uniform with her mother by her side. </p> <p>The emotional post came on the heels of international scoliosis awareness day, as she thanked the Duchess of York for taking her disability seriously when she was young. </p> <p>"My mum caught my scoliosis early and I was lucky enough to get the help I needed at 12 years old," the post said.</p> <p>"I thank her so much for that and also thank her for the confidence to be proud of my scar. Russell Hill's daughter shares her outrage over Greg Lynn's sentence

<p>Russell Hill's daughter has expressed her anger over the jury's verdict of former pilot Greg Lynn, who was found not guilty for Hill's murder. </p> <p>Greg Lynn faced a lengthy trial over the deaths of campers Russell Hill and Carol Clay, but after a week of jury deliberations, was only <a href="https://oversixty.com.au/finance/legal/shocking-verdict-in-trial-of-murdered-campers" target="_blank" rel="noopener">found guilty</a> for the murder of Carol and was cleared of charges relating to Russell's death. </p> <p>Following the shock verdict, Hill's daughter Debbi, said she was “angry” at the jury and that she felt her father didn’t get the justice he deserved. </p> <p>“It’s new, we’ve only just found out, but the more I think about it, the more angry I get at the fact that it didn’t have to be this way,” Ms Hill told <em>60 Minutes</em> on Sunday. </p> <p>“My dad was not a violent person in any way. He wouldn’t have provoked anything.”</p> <p>Ms Hill went on to say that she thinks about what happened to her father every day. </p> <p>“I’m just really angry that he went camping that day, that time, that he is the person he is and he happened to be right there with my dad and Carol, and this is what happened,” she said. </p> <p>“I think it was just really bad luck for Dad and Carol that they were there at the time, but it wouldn’t have happened if he [Lynn] wasn’t such an awful person.”</p> <p>After the trial concluded, more information has come to light about Lynn's past after non-publication orders were lifted.</p> <p>His first wife Lisa Lynn, 34, was found dead in the front yard of her home in 1999, with a coroner’s report indicating a blood-alcohol level of 0.21 and high levels of anti-depression medication present in her system at the time of her death. </p> <p>No suicide note was ever found and Lynn was never charged over her death, however detectives are now looking to have the Victorian coroner conduct a full inquest into the 1999 death.</p> <p>Ms Hill said it was quite concerning to learn about Lynn’s history, saying, “I hope he doesn’t get away with this, but I’ve lost a bit of faith in the whole system.”</p> <p>“I’m not trusting of it now. Nat Barr shares scary cancer diagnosis

<p>Sunrise co-host Nat Barr has shared a recent personal health scare that underscores the importance of regular skin checks.</p> <p>Barr disclosed that doctors diagnosed her with skin cancer after a persistent “pimple” on her nose prompted her to seek medical advice.</p> <p>On Tuesday's <em>Sunrise </em>program, Barr detailed her experience, explaining how a seemingly innocuous blemish led to an unexpected and concerning diagnosis. “I’ve had this pimple on my nose, it’s been about three weeks. It keeps going up, down, up, down, won’t go away,” Barr shared. This irregularity convinced her to consult a dermatologist, who used advanced AI technology along with a Spectrascope to examine the lesion.</p> <p>The specialist diagnosed the 3mm lesion as cancerous, with Barr receiving a score of 7.4 on the test, where any score above seven is indicative of cancer. “That was so tiny, it was just a tiny little red thing,” Barr said, showing just how easily such a small detail could be overlooked.</p> <p>The dermatologist’s use of AI to analyse photos of Barr’s entire body further highlighted the cutting-edge methods now available in skin cancer detection. This technology can compare images over time to identify changes more accurately than the human eye, providing a powerful tool in early diagnosis and treatment.</p> <p>Following the diagnosis, Barr was prescribed an anti-cancer cream to treat the lesion and also underwent red light therapy, a treatment that selectively targets and kills cancer cells.</p> <p>Reflecting on her experience, Barr expressed how this health scare made her more aware of the importance of regular skin checks. “It’s just a good reminder for everyone," she urged, "remember to get your skin checked regularly."</p> <p>Despite the scare, Barr reassured her fans about her health. “The outlook for my health is fine,” she confirmed, noting that her next appointment is scheduled for Friday. In the meantime, she mentioned that the lesion is currently concealed with make-up. “I do the same process this Friday, and then it gets all crusty, and then it will be fine,” she added.</p> <p>Skin cancer, often underestimated, can start as something as small as a persistent pimple or a red spot. Aussies urged to claim their share of millions of unclaimed cash

<p>Aussies are being urged to claim their share of $577 million which is sitting unclaimed with Revenue NSW, with about $234 million of that designated as belonging to residents who have yet to claim it.</p> <p>During the last financial year, NSW Government returned more than $21.8 million in unclaimed funds to Aussies, setting a record in the process. </p> <p>The unclaimed funds are comprised of payments, refunds, unpresented cheques, dividends and other money that organisations cannot transfer to its rightful owners, sometimes due to something as simple as changed addresses or bank accounts.</p> <p>While $234 million is being held by the government for NSW residents who are known, the further $343 million is designated to those who live outside New South Wales or are currently unknown. </p> <p>For Sydney residents alone, approximately $85.4 million is currently waiting to be claimed by rightful owners. </p> <p>The average amount of unclaimed money owed on the register is $391, and more than $154 million has been claimed back from the government in the past decade.</p> <p>“Despite doing our best to give unclaimed money back to the people it’s owed to, we’re still seeing more money referred to us than people are claiming,” Chief Commissioner of State Revenue Scott Johnston said.</p> <p>“We want to make sure everyone knows about the unclaimed money register, so they can jump online, find out if any money is owed to them and undertake the process to get it back."</p> <p>“That way we can ensure more money is being returned to those it belongs to, rather than sitting with us for extended periods of time after enterprises and organisations pass it on.”</p> <p>You can find more information about the unclaimed funds, and search the register for your share on <a href="https://www.revenue.nsw.gov.au/unclaimed-money" target="_blank" rel="noopener" data-link-type="article-inline">Revenue NSW’s website</a>.</p> <p><em>Image credits: Shutterstock </em></p>

How to buy a home: 7 tips for negotiating like a pro

Good negotiations greatly improve relationships between buyers, sellers and agents. They also help avoid future problems and conflicts.</p> <p>Negotiating skills become even more important for home buyers in a “seller’s market”, where demand from buyers exceeds supply from sellers. That’s <a href="https://propertyupdate.com.au/australian-property-market-predictions/">currently the case</a> in all Australian capital cities and major regional cities such as Gold Coast, Sunshine Coast and others.</p> <p>Many home buyers mistakenly believe negotiation only occurs during the signing of the sale contract. However, it involves distinct stages: <em>pre-negotiation</em> and <em>during negotiation</em>.</p> <p>So how can people maximise their chances of successfully negotiating a purchase in a seller’s market? I offer the following tips.</p> <h2>Be someone the seller’s agent wants to do business with</h2> <p>Buyers often communicate solely with the seller’s agent, rather than directly with the seller. It’s crucial to ensure the agent views the buyer positively. Ultimately, it’s the agent who presents offers to the seller for their decision.</p> <p>It’s important, then, to understand what might motivate the seller’s agent to choose your offer. The key performance indicator for the agent often revolves around closing a property sale at a reasonable price within a certain time.</p> <p>This means price is a crucial factor. However, other factors can influence the seller’s agent and seller.</p> <p>For example, having pre-approved finance can increase the agent’s confidence in the buyer. If the buyer appears serious, can make quick decisions and makes a good impression, the agent may be more motivated to push for them, even if their offer is slightly lower than others without pre-approved finance.</p> <h2>Be a big fish (for the seller’s agent)</h2> <p>The next strategy is to give the seller’s agent extra incentive to favour you and your offer. <a href="https://www.emerald.com/insight/content/doi/10.1108/MIP-09-2019-0489/full/html">Our research</a> in customer behaviour suggests businesses value customers who make frequent purchases or engage them for long-term services.</p> <p>For example, the agent would be pleased to learn that the buyer might be interested in buying another property in the near future or in using their rental service for the new property. You have an advantage if you can position yourself as someone who could provide them with extra business.</p> <h2>Point to competing options</h2> <p>In a positive manner, let the seller’s agent know you are considering two or three properties, and this specific property is among those you are inclined to make an offer on.</p> <p>In certain situations, it may stimulate competitive pricing when multiple properties of similar quality are available in the same area. Make it clear to the agent you will choose the property that offers you the best overall value.</p> <p>While this strategy might not necessarily lower the price in a seller’s market, it can prompt the agent to have a fuller discussion with you.</p> <h2>Think beyond price</h2> <p>The next set of tips focuses on the <em>during negotiation</em> stages. It can be challenging for buyers to negotiate a lower price in a market with low supply and high demand. You might have to “think outside the price box”.</p> <p>Buyers often have a specific price range or fixed budget in mind when they start discussions with a seller. However, other factors besides price can influence a property’s overall value.</p> <p>So if a seller won’t adjust the price, consider negotiating for other concessions that could reduce your expenses.</p> <p>These may include:</p> <p><strong>Settlement period</strong></p> <p>Consider the expenses associated with the settlement period. A shorter settlement period could enable buyers to move into the property sooner and save on rent. For example, if a buyer is paying $600 per week in rent, an early settlement could save them around $2,400 per month.</p> <p><strong>Insurance costs after contract signing</strong></p> <p>In many states, buyers’ <a href="https://www.finder.com.au/home-insurance/home-insurance-cost">home insurance cover</a> is required to begin from the date of contract signing. It’s reasonable for buyers to include a special condition requesting the seller to bear the insurance costs until settlement. On average, home insurance may amount to about $140 per month.</p> <p><strong>Cleaning expenses</strong></p> <p>Consider negotiating a condition stipulating that the seller must ensure the property is professionally cleaned by settlement. Failure to do so could result in a $500 adjustment in the buyer’s favour at settlement.</p> <p>In some states, like Queensland, sellers are not obligated to deliver a clean property. Based on typical end-of-lease cleaning charges, internal cleaning of a four-bedroom property could cost <a href="https://firstcallhomeservices.com.au/service-menu/bond-exit-end-lease-cleaning/">$455 to $590</a>.</p> <p><strong>Building and pest inspection costs</strong></p> <p>Buyers should always include a 14-day pre-purchase inspection clause for <a href="https://www.topdogpestcontrol.com.au/building-pest-inspections-gold-coast/">building and pest inspections</a> in their offer. Although they may cost $300 to $600, these inspections provide a clear report that could lead to negotiations after contract signing if they find any issues with the property.</p> <h2>Be careful with your first offer</h2> <p>Don’t present the first offer in writing. It can be challenging to negotiate down the price once it has been written in an offer document.</p> <p>Instead, the buyer should begin by testing the expected price of the property. As well as obtaining property reports from multiple banks, the buyer could talk with the seller’s agent in person about a price range that would be agreeable to the seller.</p> <p>You could include phrases like “a price that will make the seller happy” or “a price that will make the seller accept the offer”. While the agent might not provide a specific price, this talk can provide a guideline for the buyer. All properties up for auction or private sale should have an expected price set, which may or may not be discussed with potential buyers.</p> <p>It’s also advisable to consult a solicitor before submitting an offer or signing a contract. They can offer valuable suggestions to smooth the purchase process and identify any issues.</p> <h2>Use the power of 900</h2> <p>Buyers often submit offers with round numbers, such as $700,000 or $750,000. In a competitive seller’s market, aim to submit an offer with a number that stands out from the rest, yet remains within your budget.</p> <p>An example of such a number is $900. For instance, comparing $700,000 to $700,900, the extra $900 makes the offer feel closer to $710,000.</p> <h2>Write a personalised letter</h2> <p>It’s true the most important point of selling a house for many sellers is price. But they are human and have emotions. Finishing a purchasing offer with a personal letter to the seller can make a difference.</p> <p>Often that $3,000 to $20,000 could be a lot of money for a buyer, but it may not be as much for someone selling a house for $700,000 or $1,000,000. Write the letter to express your feelings about the property in a way that makes it clear you will care for it. Princess Diana's brother shares "immensely sad" personal news

<p>Princess Diana's younger brother Charles Spencer has shared that he and his wife are divorcing after 13 years of marriage. </p> <p>The Earl's relationship with his wife, Karen Gordon, reportedly broke down while Spencer was writing his harrowing memoir which detailed the physical and sexual abuse he suffered at boarding school. </p> <p>Revealing the split to the <em><a href="https://www.dailymail.co.uk/news/article-13509355/charles-spencer-sad-divorce-wife-memoir.html" target="_blank" rel="noopener">Mail on Sunday</a></em>, the 60-year-old said, "It is immensely sad."</p> <p>"I just want to devote myself to all my children, and to my grandchildren, and I wish Karen every happiness in the future."</p> <p>Spencer and Gordon, a Canadian philanthropist, first met on a blind date at a restaurant in Los Angeles in 2010, and got married just one year later in June 2011 on the Althorp estate, where Princess Diana is buried. </p> <p>The couple share a 12-year-old daughter named Charlotte Diana, while Spencer also has four children from his previous marriage to his first wife, Victoria Lockwood, and two children with his second wife, Caroline Freud.</p> <p>Karen was notably absent at events held at Althorp and Spencer House in London in mid-March to launch the Earl's tell-all book, <em>A Very Private School</em>.</p> <p>Charles Spencer told the <em>Mail on Sunday</em> that the five years of work on his memoir has deeply affected him and led to him undergoing residential treatment for trauma late last year.</p> <p>In a March interview with <em><a href="https://people.com/charles-spencer-reveals-he-was-sexually-abused-by-a-woman-as-a-child-at-boarding-school-8606246" target="_blank" rel="noopener">People</a></em>, Spencer opened up about how “supportive” Karen had been throughout his healing journey as he recalled the traumatic details of his childhood.</p> <p>“I think it was very challenging for her to have a husband going through what was essentially four and a half years of the most profound therapy with very difficult undertones to it. And she supported the idea of me doing it,” he said.</p> <p>“I think she always hoped I would come out happier and healthier and that seems to be the case very much. "Rentirement": Bold new proposition for housing crisis

<p>Aussies over 67 are being urged to rent out their homes and retire overseas in a bold new housing proposition floated by Suburbtrends. </p> <p>The property sector market researchers said that “rentirement” is a viable solution to the nation’s current housing crisis, as it would open up  over 137,000 homes. </p> <p>Suburbtrends founder Kent Lardner said that current attempts of easing rental stress is not adequate enough.</p> <p>“While increasing housing supply is essential, it simply won’t come fast enough to address the immediate needs of renters.”</p> <p>Rentirement encourages those aged 67 to 77 to release their homes into the rental pool, and retire overseas, with Southeast Asia proposed as an ideal destination due to its significantly lower cost of living. </p> <p>“Our data shows that over 137,000 homes could be released into the rental market if just 10 per cent of the Rentirees cohort participated,” he said.</p> <p>“This represents a substantial untapped resource that could drastically ease rental pressures.”</p> <p>The initiative would offer a five-year moratorium on the loss of the primary place of residence benefit, which they believe this would be a “win-win” situation retirees, renters, and the government, as it could help provide more housing options.</p> <p>“Rentirees can enjoy a higher quality of life at a fraction of the cost, renters gain access to more housing, and the government can alleviate pressure on the housing market without significant expenditure,”  he said. </p> <p>Lardner added that “rentirement” would lead to an immediate influx of rental properties, stabilising prices and reducing vacancy rates.</p> <p>“We believe rentirement offers a practical and timely solution to Australia’s rental crisis,” he said. </p> <p>“It’s time to think outside the box and explore every avenue to ensure a stable, affordable housing market for all Australians.”</p> <p>This comes after PropTrack reported that there has been a drastic reduction in affordable rental homes, with the amount of rental properties costing less than $400 a week plummeting from 43.2 per cent at the start of the pandemic to just 10.4 per cent now.</p> <p><em>Image: Steve Tritton/ Shutterstock</em></p>
